County to spend $345,000 to attract tourists to the county.

LAKE PLEASANT—When the Hamilton County Board of Supervisors met on September 7, it authorized numerous resolutions, including the following one which basically authorizes the County to spend $172,500 to get $172,500 from the State to spend a total of $345,000 to attract tourist to the county.

CONTINUATION OF TOURIST PROMOTION AGENCY FOR HAMILTON COUNTY AND AUTHORIZING SUBMISSION OF APPLICATION TO NEW YORK STATE DEPARTMENT OF ECONOMIC DEVELOPMENT FOR MATCHING FUNDS FOR PROMOTION OF TOURISM

WHEREAS the New York State Department of Economic Development is empowered to approve application from local governments for matching funds to be used for promoting tourism therein, and

WHEREAS, the President of the Regional Office of Sustainable Tourism has recommended that an application for such funds be submitted to the Department of Economic Development for matching funds up to the amount appropriated therefore within the New York State budget, now, therefore, be it

RESOLVED, that, Michelle Clement of the Regional Office of Sustainable Tourism be, and hereby is, authorized and directed to submit an application to Kelly Rabideau-Baquerizo, Tourism Matching Funds Director, Empire State Development Division of Tourism, Albany, New York 12245, for matching funds in an amount up to One Hundred Seventy-two Thousand Five Hundred Dollars ($172,500.00) to be used for the promotion of tourism in Hamilton County, and be it further

RESOLVED, that the Regional Office of Sustainable Tourism is hereby named Project Director in relation thereto, and be it further

RESOLVED, that the Hamilton County Board of Supervisors hereby certifies to the New York State Department of Economic Development that both the County of Hamilton and the Regional Office of Sustainable Tourism have been in existence for more than three (3) years, and be it further

RESOLVED, that in order to comply with Commerce Law, Article 5-A (New York State Tourism Promotion Act) that the Regional Office of Sustainable Tourism be the duly designated tourist promotion agency for the County of Hamilton for the fiscal year of 2023/2024, and the County Treasurer be so advised.


AUTHORIZING A PUBLIC HEARING TO CONSIDER PROPOSED LOCAL LAW NO. 3 OF 2023 A LOCAL LAW TO EXTEND THE ADDITIONAL MORTGAGE RECORDING TAX WITHIN THE COUNTY OF

HAMILTON DATED: SEPTEMBER 7, 2023

RESOLVED, that proposed Local Law No. 3 of 2023 titled “A LOCAL LAW TO EXTEND THE ADDITIONAL MORTGAGE RECORDING TAX WITHIN THE COUNTY OF HAMILTON”, attached hereto and made a part hereof, be, and the same hereby is introduced before the Hamilton County Board of Supervisors, and in order to give interested members of the public the opportunity to be heard thereon, the Board of Supervisors shall hold a public hearing at the Supervisors’ Rooms in the Hamilton County Municipal Building on the 5th day of October, 2023, at 11 a.m., on the matter of the adoption of said proposed Local Law No. 3 of 2023, entitled “A LOCAL LAW TO EXTEND THE ADDITIONAL MORTGAGE RECORDING TAX WITHIN THE COUNTY OF HAMILTON”, and it be further RESOLVED, that the Clerk of the Board of Supervisors be, and she hereby is authorized and directed to give notice of such public hearing in the manner provided by law.

APPROVAL OF BIDS ON AUCTIONED TAX PARCELS

WHEREAS the County of Hamilton held the annual foreclosure auction on-line on August 28-30, 2023, and

WHEREAS, attached hereto and made part hereof is Schedule “A” which contains the names of the high bidder, the tax parcel number, and the bid price for each parcel, and

WHEREAS, the Hamilton County Treasurer has reviewed the bids for each tax parcel and recommends that the Board of Supervisors approve the bids and sale of said parcels to the high bidders, be it

RESOLVED, that the Hamilton County Board of Supervisors, pursuant to Section 116 of the Real Property Tax Law of the State of New York, does hereby approve the bid price for each map parcel shown on “Schedule A” and does hereby authorize the transfer of said property to the named high bidder subject to receipt of the entire bid amount along with associated transfer costs and the approval of the County Attorney, and be it further

RESOLVED, that the Hamilton County Board of Supervisors does hereby authorize the Chairman of the Hamilton County Board of Supervisors to execute Quit Claim Deeds for said tax map parcels to the high bidder and to execute all other necessary documents to transfer said tax map parcels to the high bidder.

CONTRACT WITH THE UNIFIED COURT SYSTEM FOR COURT CLEANING AND MINOR REPAIRS – 2023-2028

WHEREAS, the State of New York, pursuant to the laws of 1996, Chapter 686, began to assume responsibility for the costs of cleaning and minor repairs to the court facilities, and

WHEREAS the County is now in receipt of a new five-year agreement which runs from SFY 2023-2024 through SFY 2027-2028, and

WHEREAS the initial contract period is for April 1, 2023 through March 31, 2024 for an amount not to exceed $191,827.00, now, therefore, be it

RESOLVED, that the Hamilton County Board of Supervisors does hereby authorize the Chairman to enter into a contract with the Unified Court System for the purposes of being reimbursed for the costs of cleaning and making minor repairs to the Hamilton County Court facilities, for the period of April 1, 2023 to March 31, 2028.

AUTHORIZING RETIREE HEALTH INSURANCE BENEFIT FOR STERLING GOODSPEED

WHEREAS, the Hamilton County Board of Supervisors has been asked to review the eligibility of Sterling Goodspeed for retiree health insurance under the applicable rules, and

WHEREAS the Civil Service history and payroll record represents a challenge in that as a salaried Assistant District Attorney the pattern of hours worked and hourly rates appear to bounce around without explanation, and

WHEREAS Sterling had no reason to ask for an interpretation of eligibility for County health insurance until March 1, 2012, at which time Resolution No. 93-12 of 2012 determined him eligible at 30 hours per week (full-time) $29.313 per hour, and $45,904 annual, and

WHEREAS, the Employee Handbook has different rules for those who were full-time employees of Hamilton County prior to 2010 (ten years of full-time service), and

WHEREAS, for the purpose of this review, 2009 shows an annual salary for Sterling Goodspeed of $45,225 consistent with what was determined full-time in 2012, and

WHEREAS, counting the 5 years Sterling worked as Assistant District Attorney when it appears he was clearly full-time (2009-2013), as well as the 5 years he has currently worked in an eligible position in the Public Defense Office, gives him 10 years, though not consecutive, and

WHEREAS the County in the past granted retiree health insurance benefit in the case of 15 non-consistent years, now, therefore, be it

RESOLVED, that Sterling Goodspeed is deemed fully eligible should he retire at the end of 2028, and prior to that based on the following: End of 2026 – 20% Retiree Share. No Retiree Health Insurance benefit for retirement before that date and be it further

RESOLVED, that the County Treasurer, Personnel Officer, and Sterling Goodspeed be so notified.

AUTHORIZING 28 HOUR WORK WEEK FOR ADMINISTRATIVE ASSISTANT POSITION IN THE PUBLIC DEFENDER’S OFFICE

WHEREAS, the Assigned Counsel Panel for Hamilton County has been converted to a Public Defender system, and

WHEREAS, the Public Defender’s Office presently employs an Administrative Assistant for 21 hours per week, and

WHEREAS the job responsibilities of the Administrative Assistant have expanded significantly to include state reporting on every criminal disposition in each calendar year, qualification of clients at court appearances according to state income guidelines, office management at Public Defender’s Office, file management for both criminal and family court, legal research and document preparation and general coordination of a three-attorney law practice, therefore, be it

RESOLVED, that the position of Administrative Assistant in the Hamilton County Public Defender’s Office is expanded to a work week of 28 hours with a salary rate set at $21.179 per hour so as to align with 100% reimbursement funding provided by the New York State Office of Indigent Legal Services for an annual salary of $38,546.00 effective September 11, 2023.

AUTHORIZING CHAIRMAN TO SIGN CONTRACT WITH SCHOOL DISTRICT TO PROVIDE RELATED SERVICES FOR THE PRESCHOOL SPECIAL EDUCATION PROGRAM – TOWN OF WEBB UNION FREE SCHOOL DISTRICT

WHEREAS the Hamilton County Public Health Nursing Service is required to provide for Related Services (Speech, Occupational and Physical Therapy Services) for children aged 3-5, who reside within Hamilton County and have a developmental delay as defined through a comprehensive evaluation, through the Committee on Pre-School Special Education (CPSE) process, and

WHEREAS, Town of Webb Union Free School District can provide these related services through the New York State Department of Education, and

WHEREAS the frequency and duration of services for each child is based on the findings of the comprehensive evaluation and rules applying to section 4410 of the NYS Education Law, as determined by the CPSE committee in preparing an Individualized Education Plan (IEP), and

WHEREAS the compensation for related services are set at rates in conjunction with the Rate Setting Unit of the NYS Department of Education, be it

RESOLVED, that the Chairman of the Hamilton County Board of Supervisors is authorized to enter into a contract with said provider to provide the aforesaid services for the period of September 1, 2023 through August 31, 2024 pursuant to an aforesaid IEP for each eligible child, with compensation for services rendered at the current approved rates set forth for Hamilton County by the Rate Setting Unit of the NYS Education Department, upon approval of the County Attorney, and the County Treasurer be so notified.

AUTHORIZING CONTRACT WITH SPEECH THERAPIST – HONORA BICHE DATED: SEPTEMBER 7, 2023

WHEREAS the Hamilton County Public Health Nursing Service contracts with individual providers of speech and language pathologies for several programs, and

WHEREAS, Honora Biche of 170 Chartier Road, Northville, NY 12134, is a duly licensed Speech and Language Pathologist by the NYS Department of Education, Office of Professions and wishes to contract with the Nursing Service, and

WHEREAS the term of this contract shall be from October 1, 2023 through September 30, 2024 and compensated at a rate of $75.00 per visit, be it

RESOLVED, that the Chairman of the Board of Supervisors is authorized to enter into a contract with Honora Biche, SLP to provide speech therapy to the residents of Hamilton County, for the period October 1, 2023 through September 30, 2024 at a rate of $75.00 per visit, upon approval of the County Attorney and the County Treasurer be so notified.

AUTHORIZING THE 2023 CHILD & FAMILY SERVICES PLAN ANNUAL UPDATE 

WHEREAS Resolution No. 119-18 adopted April 5, 2018 authorized the April 1, 2018- March 31, 2023 Child & Family Services Plan, and

WHEREAS, New York State Office of Children and Family Services extended the current plan cycle through June 30, 2024, and

WHEREAS Roberta A Bly has provided the Hamilton County Board of Supervisors with the April 1, 2023- March 31, 2024 Child & Family Services Plan Annual Update, be it

RESOLVED, that Roberta A Bly, Commissioner of Social Services & Executive Director of the County Youth Bureau; Amy Granger, Probation Director and the Chairman of the Hamilton County Board of Supervisors are authorized to sign.

AMEND COUNTY BUDGET AND CONTRACT WITH THE HAMILTON, FULTON, MONTGOMERY PREVENTION COUNCIL

WHEREAS, the County of Hamilton has approved the 2023 contract with the Hamiton, Fulton, Montgomery Prevention Council to provide Prevention Services to the residents of Hamilton County, and

WHEREAS NYS OASAS funding was increased in the most recent State Aid Letter by $2,384.00, and

WHEREAS the current contract does not reflect this increase in the County’s 2023 budget, be it

RESOLVED, that Revenue Acct. No. A.3484.100 and Expenditure Acct. No. A.4310.0425 both be increased by $2,384.00, and be it further

RESOLVED, that the Hamilton County Board of Supervisors hereby approves amending the County’s 2023 contract with Hamilton, Fulton, Montgomery Prevention Council from $78,449.00 to $80,833.00, and the Treasurer be so advised.

CREATING REVENUE AND EXPENDITURE ACCOUNTS FOR SYSTEM OF CARE GRANT – COMMUNITY SERVICES

WHEREAS, Hamilton County Community Services has been awarded a grant to develop a System of Care, and

WHEREAS there is not currently a revenue and expenditure account associated with this grant, be it

RESOLVED, that Account No. A4310.0411 Systems of Care Grant be created in the amount of $22,334.00 to be totally offset by creating Revenue Account No. A4490.0200 Systems of Care Grant in the amount of $22,334.00.

CREATING SECRETARY POSITION - COMMUNITY SERVICES

WHEREAS Hamilton County Community Services department will have a vacancy in the Clerk position as of September 11, 2023, and

WHEREAS the duties of the position require a higher skill level than that of Clerk, be it

RESOLVED, that the current Clerk position become a Secretary position, and be it further RESOLVED, that Account No. A4310.0104 and Account No. A4320.0104 be renamed

Secretary, and be it further

RESOLVED, that the Personnel Officer be authorized to advertise the vacant position as a Secretary position and the County Treasurer and Director of Community Services be so notified.

CREATION OF MENTAL HEALTH THERAPY AIDE POSITION – COMMUNITY SERVICES

WHEREAS, Hamilton County Community Services is no longer providing Health Home Management Services, and

WHEREAS there is a need for intensive in-home services to support the Mental Health Therapy being provided by Hamilton County Community Services’ Social Workers, and

WHEREAS Hamilton County Community Services receives State Aid to provide Case Management Services for 2024, and

WHEREAS Hamilton County Community Services would like to create the Mental Health Therapy Aide position to address those needs using State Aid funding and said position will begin in January 2024, be it

RESOLVED, the Mental Health Therapy Aide position be created to be filled January 2024.

OFFERING REQUEST FOR APPLICATIONS FOR PREVENTION SERVICES – COMMUNITY SERVICES

WHEREAS, due to staffing concerns the Hamilton County Community Services Prevention Program is not sustainable, and

WHEREAS, Hamilton County Community Services Board has recommended contracting a community-based organization to operate said services, and

WHEREAS Hamilton County Community Services receives State Aid for those services, be it

RESOLVED, that the Director of Community Services be authorized to prepare a Request for Applications for the provision of Prevention Services with the State Aid allotted for those services.

AUTHORIZING THE EXTENSION OF HAMILTON COUNTY’S CONTRACT WITH THE REGIONAL OFFICE OF SUSTAINABLE TOURISM FOR THREE YEARS

WHEREAS the Hamilton County Board of Supervisors authorized ROOST to provide the Tourism Promotion services for Hamilton County through 2023, and

WHEREAS this contractual relationship has been very successful and of great benefit to Hamilton County, and

WHEREAS, both Hamilton County and ROOST are in favor of extending the contract, and

WHEREAS the current contract with ROOST ends December 31, 2023, now, therefore, be it

RESOLVED, that the 2024 contract will have a 10% increase over the previous contract to cover rising costs, and be it further

RESOLVED, that with the County Attorney’s approval, the Chairman of the Board of Supervisors is hereby authorized to sign a 3-year contract with ROOST.

AUTHORIZING PAYMENT TO WARRENSBURG COLLISION CENTER, INC. – INSURANCE REPAIR

WHEREAS Vehicle #621 - 2019 Chevy 3833 was involved in an accident and the repairs for the damage were completed by Warrensburg Collision Center, Inc., and

WHEREAS, the Fleet Coordinator recommends the payment of said repairs of the 2019 Chevy 3833, be it

RESOLVED, the County Treasurer is hereby authorized to increase Account No. A1910.0402 Repairs to Vehicles-Insurance by $2,684.70 to be totally offset by increasing Revenue Account No. A2680.0000 Insurance Recoveries by $2,684.70, and be it further

RESOLVED, that the County Treasurer is hereby authorized to make a check payable to: Warrensburg Collision Center, Inc. 3985 Main Street Warrensburg, NY for Invoice #6228 in the amount of $2,884.70 and the funds be taken out of Account No. A1910.0402 Repairs to Vehicles-Insurance and the Fleet Coordinator and Clerk of the Board be so notified.

AUTHORIZING PAYMENT TO TECHNICAL BUILDING SERVICES (TBS) – INDIAN LAKE COUNTY FACILITY

WHEREAS Resolution No. 215-23 authorized the purchase and installation of AC condensers in the Social Service and Legal Wings in the Indian Lake County Building Facility by Technical Building Services, Inc. (TBS) at a cost of $38,250.00, and

WHEREAS, during installation of the AC condensers TBS recommended the installation of drains for the A-coils that wasn’t part of the original specifications, and

WHEREAS the Superintendent authorized the drains to be installed upon the recommendation of TBS, and

WHEREAS the drains are installed and have been inspected by the DPW Building Project Supervisor and deemed complete, be it

RESOLVED, that hereby the County Treasurer is authorized to make payment to Technical Building Services, Inc., 12E Commerce Drive, Ballston Spa, NY 12020-3631 in the amount of $1,100.00 from Account No. A1620.414 Five-Year Building Project Plan and the DPW Superintendent and Clerk of the Board be so advised.

APPROVAL OF EXPENDITURES FOR CONSTRUCTION OF COUNTY ROAD FUND PROJECTS FOR 2023

WHEREAS there has been appropriated in the 2023 highway budget the sum of

$1,373,283.85 for the construction of County Road Fund Projects for 2023 and these funds are 100% reimbursed through the Consolidation Highway Improvement Program (CHIP’s), and

WHEREAS, the County Highway Superintendent has recommended the expenditure of $75,000.00 for the construction of the following project:

COUNTY ROAD PROJECT NO. 6 Town of Wells Co. Rd. No. 16 – Gilmantown Road Rd., Bank stabilization, Culvert Installation & Base & Top @ 20 ft. Approx. 600 feet…$75,000.00 Account No. D5112.2539 and

WHEREAS the above designated road is on a completed system of the Hamilton County road map adopted by the Board of Supervisors of Hamilton County and approved by the Commissioner of Transportation, be it

RESOLVED, that the Board of Supervisors of the County of Hamilton does allot and appropriate from Account No. D5112.0202 Capital projects, the sum of $75,000.00, for the construction of the above designated project as recommended by the County Highway Superintendent and the County Treasurer and Clerk of the Board be so advised.

APPROVAL FOR AMENDING CONSTRUCTION OF COUNTY ROAD FUND PROJECTS FOR 2023

WHEREAS Resolution No. 161-23 authorized the construction of County Road Fund Projects for 2023, and

WHEREAS, due to weather-related issues the Superintendent recommends the adjustments or delays of certain projects authorized for 2023, and

WHEREAS the Superintendent recommends the postponement of the following approved projects until 2024 - COUNTY ROAD PROJECT NO. 3 Town of Wells Co. Rd No. 8 – Griffin Road, HMA overlay Base & PPST Top @ 20 ft. Approx. 1.5 mile…$210,000.00 Account No. 5112.2536

COUNTY ROAD PROJECT NO. 5 Town of Indian Lake Co. Rd. No. 4 – Big Brook Road, Replace Large Culvert, and pave Base and Top Approx. 0.4 miles…$100,000.00 Account No. 5112.2538 and

WHEREAS the total CHIP’s appropriation for County Road Projects No.3 and No.5 totals $310,000.00, and

WHEREAS the Superintendent recommends that $310,000.00 be transferred back into Account No. D5112.0202 Capital Projects, and

WHEREAS the Superintendent recommends amending the following County Road Capital Projects for 2023 as follows –

COUNTY ROAD PROJECT NO. 1 Town of Indian Lake

Co. Rd. No. 12 – Cedar River Rd., Improve drainage, recycle base and HMA Base @ 21 ft. Approx. 2.4 miles… $500,000.00

RESOLVED, that the Board of Supervisors of the County of Hamilton does approve the adjustments and postponements of the above designated projects as recommended by the County Highway Superintendent and that the other County Road Capital Projects remain the same, be it further.

RESOLVED, that hereby the County Treasurer be so authorized to make the transfers and adjustments to the above designated projects and the DPW Superintendent and Clerk of the Board be so advised.

AUTHORIZING PAYMENT FOR REPAIRS TO TRUCK #121

WHEREAS the DPW owns a 2012 International Paystar tandem dump truck that required the replacement of the high-pressure fuel pump and EGR valve and other emission repairs, and

WHEREAS the Superintendent sent the truck to H. L. Gage to diagnose the mechanical issues the truck was having and to have the repairs completed and the repairs were completed to truck #121 at a cost of $15,045.86 and the said truck is back in service, be it

RESOLVED, that hereby the County Treasurer is hereby authorized to send payment to H.L. Gage Sales, Inc., PO Box 5170, Albany, NY 12205 in the amount of $15,045.86 for truck #121 and the funds be taken out of Account No. DM5310.0401 Repairs and Clerk of the Board and Highway Superintendent be so notified.

AUTHORIZING PURCHASE FOR 2022 SHERIFF VEHICLE

WHEREAS the Sheriff’s Office is need of a new vehicle for 2024, and

WHEREAS, because of the market shortages vehicles are very difficult to purchase, and WHEREAS, a 2022 Ram SSV pickup has become available from Main Motor Car that is under New York State Contract, and

WHEREAS, the Fleet Coordinator has met with the Public Works Committee and the Sheriff, and

WHEREAS, the Fleet Coordinator recommends the purchase of one (1) new Ram SSV Crew Cab Pickup, be it

RESOLVED, that the Fleet Coordinator is hereby authorized to order one (1) 2022 Ram SSV Pickup for the Sheriff’s Office mentioned herein for a total of $42,247.00 delivered from Main Motorcar, Johnstown, NY under NYS State Police Mini Bid #8161, Contract PC66680, and be it further

RESOLVED, that $42,247.00 be transferred from the Unappropriated General Fund Balance in accordance with Section 366 Subdivision 1 of the County Law to Account No. A3110.0202 Automobile to cover the cost of the vehicle and the County Treasurer be so authorized and the Sheriff, Fleet Coordinator and the Clerk of the Board be so notified.

AUTHORIZING PURCHASE OF ONE VEHICLE - DPW

WHEREAS the Public Works department is need of a vehicle and because of the ability to purchase vehicles continues to be difficult, the Superintendent recommends purchasing when vehicles become available that are on contract pricing, and

WHEREAS, the Fleet Coordinator has met with the Public Works Committee to discuss the said vehicle purchase, be it

RESOLVED, that hereby the Fleet Coordinator is authorized to purchase one (1) New 2023 Dodge Durango with options from Main Motorcar of Johnstown, NY under New York State Contract PC66680, Mini Bid #13382 pricing at a cost of $44,610.00 delivered, be it further

RESOLVED, that the funds be taken out of Account No. DM5130.0201 Road Equipment and the County Treasurer, Fleet Coordinator and Clerk of the Board be so advised.

AUTHORIZING COUNTY HIGHWAY SUPERINTENDENT TO PURCHASE KOBELCO EXCAVATOR – DPW (Highway)

WHEREAS, the DPW Superintendent has met with the Public Works Committee in regard to purchasing a Kobelco SK140 Excavator under Sourcewell Contract pricing, and

WHEREAS, the Public Works Committee recommends the purchase of the said excavator, be it

RESOLVED, that the Board of Supervisors authorizes the DPW Superintendent to purchase a 2023 Kobelco SK140-SR-7 with options delivered in the amount of $179,702.30 under Sourcewell Contract #011723-KBL from Robert H. Finke and Sons, Inc. of Selkirk, NY, and this will be a charge to Account D5112.0202 Permanent Improvements (CHIP’s) and the DPW Superintendent, County Treasurer and Clerk of the Board be so advised.

RELOCATE FUEL DEPOT EQUIPMENT AT THE ARIETTA FUEL STATION FOR HAMILTON COUNTY

WHEREAS, Hamilton County is responsible for the maintenance and operation of the Arietta Fuel Depot located at the Town of Arietta Highway Garage, and

WHEREAS, the Town of Arietta has completed a new highway garage onsite and will be demolishing the old highway garage, and

WHEREAS the electrical, safety and communication equipment for the fuel station that was installed in the old highway garage needed to be relocated, and

WHEREAS, said equipment was removed from the old highway garage and installed in a closer building onsite with new conduits, lines, and panels replaced as needed by R.M. Dalrymple, the vendor that services all of the Hamilton County Fuel Depots, and

WHEREAS this contract is valid for the remainder of 2023 and 2024, and

RESOLVED, that the Hamilton County Emergency Services Office be authorized to purchase this one-year plan for microwave and IP/MPLS Maintenance Funding for this Purchase Order will be covered by funds available from NYS Department of Homeland Securities and Emergency Services, Office of Interoperable Communications Formula Grant SICG FY 18 Targeted grant, Account No. A3645.0428 ST18-1005-D00.

AUTHORIZING HAMILTON COUNTY TO JOIN THE RURAL HOUSING COALITION OF NEW YORK

WHEREAS, The Rural Housing Coalition of New York represents rural preservation companies, and other housing and community development professionals from government, non- profits and the private sector that share a common interest in serving all the residents of rural New York State, and

WHEREAS, The Coalition provides its members with training and technical assistance, networking opportunities with colleagues from around the state and serves as an information resource for funding, relevant laws and regulations, sample policies and best practices, and

WHEREAS Hamilton County like many other Counties in the Adirondacks is struggling with Workforce Housing, and Workforce Housing affordability, now, therefore, be it

RESOLVED, that this Resolution Authorizes Hamilton County to join the Rural Housing Coalition of NY, and be it also

RESOLVED, that the Hamilton County Clerk of the Board of Supervisors is hereby authorized to use the County Credit card to pay the membership fee ($250) to join.

AUTHORIZING REPLACEMENT OF BOILER – INDIAN LAKE DPW FACILITY DATED: SEPTEMBER 7, 2023

WHEREAS the heating boiler in the Indian Lake highway facility is need of replacing, and

WHEREAS, the Buildings Project Supervisor has request written quotes from three vendors and have received two written quotes for the purchase of the boiler and related supplies as follows –Security Supply, Johnstown, NY - $13,486.61; F. W. Webb, Queensbury, NY - $14,776.46; J. E. Sawyer, Glens falls, NY – Did not return a written quote and

WHEREAS the DPW Superintendent recommends purchasing the Boiler and related supplies from Security Supply, and

WHEREAS, the Buildings Division will installing the said boiler in-house, be it RESOLVED, that hereby the Board of Supervisors authorizes the Superintendent for the purchase of the boiler and related supplies as recommended and it will be a charge to Account No. A1620.0414 Five-Year Building Project Plan and the County Treasurer, Clerk of the Board and DPW Superintendent be so notified.

AUTHORIZING AND FUNDING CAPITAL PROJECT FOR DAMAGE REPAIR FROM DR4723 JULY 2023 FLOODING

WHEREAS, on July 10, 2023 Hamilton County was hit by torrential rain, and

WHEREAS Hamilton County owned infrastructure of road and bridges received damage from the torrential rain flooding, and

WHEREAS, the County DPW department has begun repairing the damages to get roads and bridges reopened, and

WHEREAS, the DPW has needed to purchase materials such as crushed stone and crusher run gravel along with rental of equipment and has a contractor in place to begin repairing bridge abutment scouring, and

WHEREAS the DPW needs to have funding available for these resources while state and federal government agencies complete damage assessments from the disaster for Hamilton County for the related storm damage, and

WHEREAS, in the first instance the DPW Superintendent recommends the transfer of $100,000.00 from the County Road Fund balance to fund the permanent repairs, be it

RESOLVED, that $100,000.00 be transferred from County Road Fund Balance to Capital Account No.H2.8760.0401 July 2023 Flooding and that hereby the County Treasurer is authorized to make the said transfer and the Clerk of the Board and County DPW Superintendent be so notified.

County seeks broadband help

LAKE PLEASANT—When the Hamilton County Board of Supervisors met on August 3, it passed numerous resolutions including the one following which calls upon the State of New York to work with Frontier to expand broadband coverage.

ASKING FOR THE ASSISTANCE OF THE NYS CONNECTALL OFFICE, NYS PSC, AND FCC IN DEALING WITH THE UNCERTAINTY OF PLANNING FOR BROADBAND WITH AND AROUND FRONTIER COMMUNICATIONS SERVICE AREA

WHEREAS Frontier Communications provides significant Broadband coverage/service in 8 out of 9 of the Towns in Hamilton County and across NYS, and

WHEREAS, Frontier Communications also has RODF (Rural Digital Opportunity Fund) Awards in each of those 8 Towns (across NYS Frontier was awarded $37,291,314.60 for 12,226 units assigned), and

WHEREAS none of the awarded areas in Hamilton County have currently been built, nor are they under construction, nor even permitted, as we understand the current situation, and

WHEREAS Hamilton County also understands we are not the only County in the State or within the Country in this same position, and

WHEREAS the excess amount of time allowed for construction under the RDOF program creates a significant challenges when our residents, children, and schools have immediate needs, and

WHEREAS, Hamilton County, like many other Counties within NYS, has worked diligently on Broadband mapping (local work, PSC maps, FCC maps), all an effort to have quality information to plan from, and

WHEREAS Hamilton County takes very seriously our responsibility for working with NYS and the ConnectAll Office, as we seek funding to fill the remaining Broadband gaps across Hamilton County, and

WHEREAS key to our ability to plan, is being able to have open and engaged conversations with all the providers who are in a position to partner with the County in providing service, and

WHEREAS, for Hamilton County, Frontier Communications is a key player in terms of their current footprint, the RDOF Award, as well as in helping to fill the additional gaps, and

WHEREAS, Hamilton County, and as we understand it other Counties in NYS are all struggling to plan around the uncertainty of the RDOF Awards (10 years to build out), now therefore, be it.

RESOLVED, that Hamilton County calls upon the NYS ConnectAll Office (as the future funds administrator), NYS PSC (as the NYS Mapping entity and also the overseer of part of Frontier Communications Service), as well as the FCC to work with all involved Counties to immediately set up a planning meeting with Frontier Communications so the following can be determined:

• What RDOF projects will be completed and by when?

• When will other System improvement work or Broadband expansions take place, if any are planned?

• What is the best model for dealing with County identified gaps or county/customer identified problems?

RESOLVED, that a copy of this Resolution be forwarded to the Governor, ConnectAll Office, PSC, FCC, Adirondack Inter-County, NYSAC, and NACo.

PROCLAMATION FOR CONNIE MAHONEY 

On the Occasion of her Retirement

WHEREAS we would like to express special recognition to Connie Mahoney and to honor her for twenty-two plus years of distinguished service with Hamilton County; and 

WHEREAS Connie began her career on December 26, 2000 as a Part-time Account Clerk in the District Attorney’s office. On June 10, 2003, Connie’s position transitioned to full-time. After serving approximately 17 years in the District Attorney’s office, Connie changed careers and moved to the Department of Social Services, working as a Social Welfare Examiner; and 

WHEREAS the Hamilton County Board of Supervisors wishes to express its sincere appreciation to Connie for her dedication to the outstanding performance of her duties during her tenure; and 

WHEREAS it is the desire and honor of this Board to honor Connie Mahoney 

NOW, THEREFORE, BE IT RESOLVED, that we, the Hamilton County Board of Supervisors, do hereby commend and honor Connie Mahoney for her many years of service and dedication as a Hamilton County employee and extend our heartfelt thanks for a job well done and offer our good wishes for an enjoyable retirement.

BODY CAMERAS AND TASERS FOR THE SHERIFF’S OFFICE 

WHEREAS, per Resolution No. 93-23 dated March 2, 2023, the Sheriff was authorized to purchase six Taser 7, six Axon Body 3 cameras with accessories and Evidence.com software, and 

WHEREAS an invoice has been received from Axon Enterprise Inc. for the new tasers, body cameras and software license for the Sheriff’s Office, be it

RESOLVED, that the County Treasurer is hereby authorized to pay Axon Enterprise for Invoice No. INUS172391 in the amount of $39,792.77 from Account No. A 3110.0418 – Sheriff ARP Act. 

RESOLUTION AUTHORIZING PAYMENT FOR UTV REPAIR 

WHEREAS the Hamilton County Sheriff’s Office loaned the 2016 Polaris UTV to New York State Department of Transportation for the flooding in Long Lake, and 

WHEREAS the 2016 Polaris UTV sustained damages that were repaired by Powerhouse Motorsports Corp. of 2493 State Highway 30, Mayfield, New York 12117, therefore, be it 

RESOLVED, that the Hamilton County Treasurer is hereby authorized to disburse to Powerhouse Motorsports Corp., $881.91 from Account No. A 3110.0401 – Sheriff Car Expense for said repairs. 

COMMUNITY SERVICES TO CONTRACT WITH LAKE PLEASANT CENTRAL SCHOOL FOR THE SCHOOL AND COMMUNITY PREVENTION INITIATIVE SERVICES 

WHEREAS, Community Services has developed a Hamilton County School and Community Prevention Initiative that offers Hamilton County Schools a Clinical Social Worker and/or a Resource Officer services at a cost of $10,000.00 per year for one day of each service per week, and  

WHEREAS Lake Pleasant Central School has agreed to contract for one (1) day per week of School Resource Officer (SRO) at a total cost of $10,000.00 for the year beginning July 1, 2023 through June 30, 2024, be it  

RESOLVED, that upon approval of the County Attorney, Hamilton County Community Services is hereby authorized to contract with Lake Pleasant Central School for a School Resource Officer for an annual amount of $10,000.00 to be billed in monthly installments of $1,000.00 beginning September 1, 2023 and ending June 30, 2024.  

CONTRACT WITH INDIAN LAKE CENTRAL SCHOOL FOR THE SCHOOL AND COMMUNITY PREVENTION INITIATIVE SERVICES

WHEREAS, Community Services has developed a Hamilton County School and Community Prevention Initiative that offers Hamilton County Schools Clinical Social Worker and/or a Resource Officer services at a cost of $10,000.00 per year for one day of each service per week, and 

WHEREAS, Long Lake Central School has agreed to contract for one (1) day per week of Social Worker Services at a total cost of $10,000.00 for the year beginning July 1, 2023 through June 30, 2024, be it 

RESOLVED, that upon approval of the County Attorney, Hamilton County Community Services is hereby authorized to contract with Long Lake Central School for Social Worker Services for an annual amount of $10,000.00 to be billed in monthly installments of $1,000.00 beginning September 1, 2023 and ending June 30, 2024. 

REPLACEMENT OF AC CONDENSERS IN THE COUNTY SOCIAL SERVICES AND LEGAL WINGS – INDIAN LAKE COUNTY FACILITY 

WHEREAS Resolution No. 215-23 authorized the purchase and installation of AC condensers in the Social Service and Legal Wings in the Indian Lake County Building Facility by Technical Building Services, Inc. (TBS) at a cost of $38,250.00, and 

WHEREAS a progress payment request of $15,300.00 has already been processed leaving the final balance upon completion of $22,950.00, and 

WHEREAS the condenser units have been fully installed and the work has been inspected by the DPW Building Project Supervisor and deemed complete, be it 

RESOLVED, that hereby the County Treasurer is authorized to make payment to Technical Building Services, Inc., 12E Commerce Drive, Ballston Spa, NY 12020-3631 in the amount of $22,950.00 from Account No. A1620.0414 Five-Year Building Project Plan and the DPW Superintendent and Clerk of the Board be so advised. 

HIGHWAY SUPERINTENDENT TO PURCHASE TRACKED SKID STEER LOADER 

WHEREAS the Public Works Department owns a 2020 289D3 Cat Compact Track Loader, and 

WHEREAS Milton Cat has offered $70,189.00 for the currently County owned 2020 Cat 289D3 in as is condition (VIN JX901722) as trade in value toward the purchase of a 2023 Cat 289D3, and  

WHEREAS the County Highway Superintendent is recommending approval to purchase the said compact loader under State Contract pricing, be it 

RESOLVED, that hereby the County Highway Superintendent is authorized to purchase said Compact Tracked Loader under New York State Contract/Sourcewell #PC69406 pricing from Milton Cat, and be it further 

RESOLVED, the County Highway Superintendent is hereby authorized to trade in the 2020 Cat 289D3 VIN No.JX901722 compact tracked loader currently owned by Hamilton County and  that the trade in value is $70,189.00 and the final cost for the purchase of the 2023 Cat 289D3 is  $25,837.00 and the 60 month extended warranty cost of $1,173.05 for a total cost of 27,010.05  and this will be a charge to Account No. D5112.0202 Capital Projects and the County Treasurer, Clerk of the Board and DPW Superintendent be so notified.  

AWARD OF BID SPECIFICATION 12-2023 – OPEN TOP EJECTOR TRAILERS DATED: AUGUST 3, 2023 

WHEREAS the Public Works Committee authorized the County Highway Superintendent to advertise for bids for the purchase of two (2) New 2023 Model Year Open Top Ejector Trailers, and 

WHEREAS one (1) bid was received for two (2) New and Unused 2023 Open Top Ejector Trailers in accordance with Specification No. 12-2023 as advertised by the Highway Superintendent and Highway Committee, and 

WHEREAS the following bid was received: 

1. Spector Manufacturing, Inc. St. Claire, PA 17970 

2023 Spec Tec Model – SEO059696 as specified Bid price $229,868.00 and 

WHEREAS, the County Highway Superintendent recommends awarding the bid to Spector Manufacturing Equipment, be it 

RESOLVED, that the award be made to Spector Manufacturing, Inc., PO Box 158, St.  Claire, PA 17970, and be it further. 

RESOLVED, that the Chairman of the Board of Supervisors is hereby authorized to enter into a contract for the purchase of two (2) new 2023 Spec Tec Open Top Ejector Trailers with Spector Manufacturing, Inc. of St. Claire, PA in the amount of $229,868.00 with the approval of the County Attorney, and be it further 

RESOLVED, that payment be made to Spector Manufacturing, Inc. within 30 days of delivery of fully equipped and operational unit and acceptance by the County Highway Superintendent and that payment be made from Account No. A8189.0401 Solid Waste Reserve in the amount of $229,868.00 and the County Attorney, County Treasurer and Clerk of the Board be so advised. 

PAYMENT FOR VEHICLES - PUBLIC HEALTH DATED: AUGUST 3, 2023 

WHEREAS Resolution No. 222-23 authorizes the County Fleet Coordinator to purchase two (2) 2023 Nissan Altima’s for use by Public Health, and 

WHEREAS the vehicles ordered were delivered, and 

WHEREAS, the County Fleet Coordinator has inspected the said vehicles and confirms they are accepted and meet specifications and recommends payment of said vehicles, be it 

RESOLVED, the County Treasurer is hereby authorized to make payment to Kingston Nissan, 140 Route 28, Kingston, NY 12401-7444 in the amount of $60,238.42 and the funds to be taken out of Account No. A4050.0201 Automobile and the Public Health Director, Fleet Coordinator and the Clerk of the Board be so notified. 

INTERMUNICIPAL EXTENSION AGREEMENT WITH FULTON COUNTY TO ACCEPT HAMILTON COUNTY’S MIXED SOLID WASTE AT THE FULTON COUNTY LANDFILL  

WHEREAS Hamilton County’s agreement with the Fulton County Landfill for disposal of County’s Mixed Solid Waste (MSW) expires on December 31, 2023, and 

WHEREAS the expiring agreement with Fulton County has an option for an extension agreement, and 

WHEREAS, the County has been negotiating with Fulton County to extend the current agreement to dispose the County’s MSW at the Fulton County Landfill located on Mud Road in Johnstown, and 

WHEREAS, the County has received an extension proposal from Fulton County that would enable Hamilton County to dispose of their MSW for a term of five (5) years beginning January 1, 2024 with an option to extend at the end of the extended five-year agreement as follows – 

January 1, 2024 – December 31, 2024 - $52.00 per ton 

January 1, 2025 – December 31, 2025 - $53.00 per ton 

January 1, 2026 – December 31, 2026 - $54.00 per ton 

January 1, 2027 – December 31, 2027 - $55.00 per ton 

January 1, 2028 – December 31, 2028 - $56.00 per ton and 

WHEREAS the DPW Superintendent feels that this proposal is an acceptable and reasonable and recommends moving forward as it provides a stable, cost-effective landfill for the disposal of the County’s MSW, be it 

RESOLVED, the Hamilton County Board of Supervisors hereby authorize the Chairman of the Board to enter into a five (5) year Inter-Municipal Extension Agreement with Fulton County for the disposal of the County’s MSW beginning January 1, 2024 with the approval of the County Attorney and the County Treasurer, DPW Superintendent and Clerk of the Board be so advised. 

REIMPOSING GENERAL SALES AND COMPENSATING USE TAXES IMPOSED AT THE RATE OF THREE PERCENT BY RESOLUTION NO. 20 OF 1968, ENACTED JANUARY 4, 1968, AS AMENDED, AND ALSO IMPOSING AN ADDITIONAL ONE PERCENT RATE OF SUCH TAXES FOR A PERIOD OF TWO YEARS, PURSUANT TO THE AUTHORITY OF SECTION 1210 OF ARTICLE 29 OF THE TAX LAW OF THE STATE OF NEW YORK

BE IT ENACTED by the Board of Supervisors of Hamilton County as follows:

RESOLUTION 210 of 2013 heretofore enacted by the Board of Supervisors is hereby amended such that Section 1 shall read as follows:

SECTION 1. Imposition of general sales and compensating use taxes. There are hereby imposed in this county and there shall be paid all of the sales and compensating use taxes described in Article Twenty-eight of the New York Tax Law as authorized by subdivision (a) of section twelve hundred ten of the Tax Law, at the rate of three percent. In addition to those taxes imposed at the rate of three percent, there are hereby imposed in this county and there shall be paid such sales and compensating use taxes at the additional rate of one percent, for the period commencing December 1, 2023, and ending November 30, 2025.

Effective date. The enactment of the foregoing amendment shall take effect December 1, 2023.

ABSTRACTING SERVICES FOR THE TREASURER’S OFFICE

WHEREAS, the Hamilton County Treasurer’s Office each year has stub searches performed on delinquent properties that are part of the foreclosure procedure, and

WHEREAS, last year this was successfully performed by Mountain Abstract Company, Inc., and

WHEREAS Mountain Abstract Company, Inc. is able to provide the abstracting services we need at the same price as last year’s services; that being $125 per new search and $50 per two-year update search, therefore, be it

RESOLVED, that the Chairman is hereby authorized to enter into an abstracting agreement with Mountain Abstract Company, Inc., PO Box 140, Chestertown, NY 12817 under the same terms and conditions as was done last year, and be it further

RESOLVED, that the Hamilton County Treasurer and Clerk of the Board be so notified.

CONTRACT WITH SCHOOL DISTRICT TO PROVIDE RELATED SERVICES FOR THE PRESCHOOL SPECIAL EDUCATION PROGRAM – INDIAN LAKE CENTRAL SCHOOL

WHEREAS the Hamilton County Public Health Nursing Service is required to provide for Related Services (Speech, Occupational and Physical Therapy Services) for children aged 3-5, who reside within Hamilton County and have a developmental delay as defined through a comprehensive evaluation, through the Committee on Pre-School Special Education (CPSE) process, and

WHEREAS, Indian Lake Central School District can provide these related services through the New York State Department of Education, and

WHEREAS the frequency and duration of services for each child is based on the findings of the comprehensive evaluation and rules applying to section 4410 of the NYS Education Law, as determined by the CPSE committee in preparing an Individualized Education Plan (IEP), and

WHEREAS the compensation for related services are set at rates in conjunction with the Rate Setting Unit of the NYS Department of Education, be it

RESOLVED, that the Chairman of the Hamilton County Board of Supervisors is authorized to enter into a contract with said provider to provide the aforesaid services for the period of September 1, 2023 through August 31, 2024 pursuant to an aforesaid IEP for each eligible child, with compensation for services rendered at the current approved rates set forth for Hamilton County by the Rate Setting Unit of the NYS Education Department, upon approval of the County Attorney, and the County Treasurer be so notified.

CONTRACT WITH LAKE PLEASANT CENTRAL SCHOOL DISTRICT TO PROVIDE SERVICES FOR THE PRESCHOOL SPECIAL EDUCATION PROGRAM

WHEREAS the compensation for special education and related services are set at rates in conjunction with the Rate Setting Unit of the NYS Department of Education, be it

RESOLVED, that the Chairman of the Hamilton County Board of Supervisors is authorized to enter into a contract with said provider to provide the aforesaid services for the period of September 1, 2023 through August 31, 2024 pursuant to an aforesaid IEP for each eligible child, with compensation for services rendered at the current approved rates set forth for Hamilton County by the Rate Setting Unit of the NYS Education Department, upon approval of the County Attorney and the County Treasurer be so notified.

CONTRACTS FOR EVALUATION AND SERVICE PROVISION WITH CENTER-BASED SERVICE PROVIDERS FOR CHILDREN AGED 3-5 YEARS

WHEREAS Hamilton County is required to provide for Comprehensive evaluations for children aged 3-5, who reside within Hamilton County and have a suspected developmental delay through the Committee on Pre-School Special Education (CPSE) process, and

WHEREAS Hamilton County is required to provide for any combination of Center-Based itinerant or related professional services including Special Education Itinerant (SEIT) Services; skilled Physical, Occupational, and Speech Therapy Related services; Counseling and/or one-on-one Aide services for children determined to have an eligible level of developmental delay and require center-based services to fully meet their needs; as defined through the CPSE Process, and

WHEREAS, pursuant to Section 4410 of the New York State Education Law, the County is required to maintain contracts with several providers for the provision of comprehensive Evaluation and specialized center-based services as described above; in order to provide parents with a choice for service provision, and

WHEREAS reimbursement for comprehensive evaluation and subsequent center-based services is determined by the extent of the evaluation and results, and based on rates set in conjunction with the Rate Setting Unit of the New York State Education Department, and

WHEREAS Comprehensive Evaluations may be requested at any time and/or professional related service provision may be requested at any time through the regular school year and/or the 30-day summer session, and

WHEREAS the Hamilton County Public Health Nursing Service represents Hamilton County as administrator of this program, be it

RESOLVED, that the Chairman of the Hamilton County Board of Supervisors is hereby authorized to sign contracts, upon approval of the County Attorney, for Comprehensive Evaluation and Center-Based professional service provision for children residing within Hamilton County at rates set by the New York State Department of Education, for the period of September 1, 2023 through August 31, 2024 between the Hamilton County Public Health Nursing Service and, not limited to but including, the following center-based preschool service providers:

LAKE PLEASANT—At a special meeting held on July 25, Hamilton County Board of Supervisors passed several resolutions, including two continuing support of emergency communications.

EXTENSION OF AGREEMENT WITH RS TELECOM FOR MICROWAVE MAINTENANCE

WHEREAS Hamilton County is in the process of procuring Microwave Service through Nokia’s OGS contract and the SmartHands provision of same, and

WHEREAS Nokia and RSTelecom need additional time to finalize the details for RS Telecom to provide SmartHands service through Nokia to Hamilton County, and

WHEREAS the County can’t be without service in the interim, and

WHEREAS, Resolution No. 263-22 of August 4, 2022 extended the current RS Telecom Contract through July 31, 2023, and

WHEREAS, Resolution No. 236-19, authorized Hamilton County to retain the professional services of RS Telecom for microwave service and maintenance for the Lake Pleasant, Oak Mt, East Mt., and Blue Mt. sites for a two-year period, subsequently extended by Resolutions 217-21 and 263-22, now, therefore, be it.

RESOLVED, that upon approval of Homeland Security and the County Attorney, the Chairman be authorized to sign a 45-day contract extension with RS Telecom to continue providing service under the same terms and conditions, and that the Emergency Services Director be so notified.

AUTHORIZING FIBER CIRCUIT THROUGH FRONTIER COMMUNICATIONS TO CONNECT LAKE PLEASANT (911 DISPATCH CENTER) TO THE HOPE TOWER SITE

WHEREAS Hamilton County is in the process of permitting an Emergency Communications Tower in the Town of Hope, and

WHEREAS there is no viable microwave path currently available to the Hope Tower site, and

WHEREAS it is critical not to delay this site any further, so Hamilton County proposes to use a Fiber connection in advance of the Microwave connection being developed, and

WHEREAS Frontier is the only provider that has Fiber directly from Lake Pleasant to Hope, now, therefore, be it.

RESOLVED, that the Hamilton County Board of Supervisors hereby authorizes a 5-year agreement with Frontier Communications, for $380.00 per month, for the necessary fiber connection (Circuit) as specified by C&S Engineering and proposed by Frontier, and be it also

RESOLVED, that no monthly payments shall be due, nor start to accrue, until the fiber connection is in place and all the equipment has been tested, and be it further

RESOLVED, that Frontier Communications and the County Emergency Preparedness Director be so notified.

PURCHASE TWO VEHICLES FOR PUBLIC HEALTH 2023

WHEREAS, Fleet Coordinator has determined the Public Health needs two new vehicles, and

WHEREAS, the Fleet Coordinator has a current a bid for a 2023 Nissan Altima in the amount of 30,119.21, and

WHEREAS the Fleet Coordinator recommends the purchase of two (2) sedans for use in 2023 as follows per NYS Contract mini-bid #23166 Vehicles:

(2) 2023 Nissan Altima AWD 4 door sedans - $30,119.21 ea.be it

RESOLVED, that the Fleet Coordinator is hereby authorized to order two (2) 2023 Nissan Altimas for Public Health mentioned herein for a total of $60,238.42 delivered from Kingston Automotive LLC, DBA Kingston Nissan, be it further

RESOLVED, that $60,238.42 be transferred from the Unappropriated General Fund Balance in accordance with Section 366 Subdivision 1 of the County Law to Account No. A4050.0201 Automobile to cover the cost of the vehicles and the County Treasurer be so authorized and the Public Health Director, Fleet Coordinator and the Clerk of the Board be so notified.

PAYMENT FOR VEHICLE - COMMUNITY SERVICES

WHEREAS Resolution Number 210-23 authorizes the County Fleet Coordinator to purchase one (1) 2023 Nissan Altima for use by Community Services, and

WHEREAS the vehicle ordered was delivered, and

WHEREAS, the County Fleet Coordinator has inspected the said vehicle and confirms it is accepted and meets specifications and recommends payment of said vehicle, be it

LAKE PLEASANT—Voting integrity is essential to democracy and when the Hamilton County Board of Supervisors met on July 6, it passed several resolution referencing elections.

CONTRACT WITH FULTON COUNTY FOR IT SERVICES - BOARD OF ELECTIONS

WHEREAS Hamilton County entered into an agreement with Fulton County for providing server and support services for the Hamilton County Board of Elections, and other services as necessary/mutually agreeable for Hamilton County Board of Elections, and

WHEREAS the Board of Elections is recommending continuing to contract with Fulton County for IT Services, and

WHEREAS, Fulton County, has made a proposal for a new contract for the server support services which includes: Operation and maintenance of the BOE server(s), Remote access to BOE systems in the event of an emergency, Regular backup of BOE Data, Remote and, if necessary, on-site support for PCs to access BOE software, Assistance with certifying compliance with NY State Cybersecurity regulations for $8,000.00 annually for support, server operation and backups, billed immediately and on-site of $60.00 per hour, plus mileage at the current IRS mileage reimbursement rate at the time of service, and

WHEREAS, the majority of the associated cost is hereby determined to be a professional service, now, therefore, be it

RESOLVED, that with the approval of the County Attorney, the Hamilton County Board of Supervisors does hereby authorize the Chairman of the Board of Supervisors to enter into a contract with Fulton County, for said services for a term of January 1, 2023 through December 31, 2023.

TRANSFER OF FUNDS – BOARD OF ELECTIONS

RESOLUTION URGING THE GOVERNOR TO VETO A.04282B/S.3505B TO MOVE CERTAIN LOCAL ELECTIONS TO EVEN-NUMBERED YEARS

WHEREAS the Hamilton County Board of Supervisors believes that increasing participation in the election process and reducing costs of government operations is good for our republic, and

WHEREAS Assembly Member Amy Paulin and State Senator James Skoufis reintroduced legislation that would move local elections to even-number years during the 2023 legislative session, and

WHEREAS versions of this legislation were introduced in previous years and failed to reach the floor for a vote due to lack of support, and

WHEREAS, after the 2022 session concluded, the bill sponsor indicated that hearings would be held on the proposal through the Election Committee process; however, there were no hearings held, and

WHEREAS the legislation passed in the middle of the night on the last days of the legislative session which is counter to the idea of an open and transparent government, and

WHEREAS, the Hamilton County Board of Supervisors has several concerns with this bill, and

WHEREAS, this legislation usurps the Home Rule powers reserved by local governments and protected by the Constitution of the State of New York, raising questions of legality and constitutional authority, and

WHEREAS local municipalities have had the ability to change their elections to even- number years for decades, and chose not to do so, and

WHEREAS we believe that establishing the schedule of local elections is the right of the local government, and has been for more than 100 years, and

WHEREAS The Assembly Bill sponsor indicated that she had not received any messages of support for this proposal from any of the 57 Counties and 933 Towns across New York State impacted by this legislation, and

WHEREAS this legislation excludes more than half of all New Yorkers who vote in cities and villages from the changes to election law, creating an inequity among New York voters, and

WHEREAS this legislation unfairly excludes the elections to offices in New York City and all other cities and villages in New York State, as well as certain offices within all counties and towns, and

WHEREAS the proposed legislation circumvented the legislative committee process during this session, limiting public input and understanding of the impacts, and

WHEREAS there has been no financial analysis or operational analysis of the impacts on local Boards of Elections, and

WHEREAS there are concerns that the current election and ballot counting technology would not be able to adequately meet the demands of the significantly increased ballot size, and

WHEREAS this will create confusion amongst voters in towns and counties across New York State, and

WHEREAS, separating the elections affords voters more time and focus to better understand important local issues and provides candidates the appropriate platforms to explain their stance on issues without having to compete against national and state level campaigns, and

WHEREAS, moving local elections to even-numbered years would increase the cost of campaigns for local office, reducing the number of candidates willing to invest funds into their own campaign, because the cost of media will increase to compete with national and state level campaign advertisements, and

WHEREAS there are significant legal and constitutional questions regarding the legality of this measure that have not been adequately addressed, now, therefore, be it

RESOLVED that this Board of Supervisors urges the Governor to oppose this legislation and utilize her veto authority to reject this proposal, and be it further

RESOLVED, that copies of this resolution be distributed by the Clerk of The Board of Supervisors to Governor Kathy Hochul, Senate Majority Leader Andrea Stewart Cousins, Assembly Speaker Carl Heastie, Senate Minority Leader Robert Ortt, Assembly Minority Leader William Barclay, Assembly Bill Sponsor Amy Paulin, Senate Bill Sponsor James Skoufis, Senator James Tedisco, Senator Walczyk, Assemblymember Smullen, Assemblymember John McDonald, Assemblymember Mary Beth Walsh, Assemblymember Carrie Woerner, and Assemblymember Matthew Simpson.

PAY PATIENT CENTERED OUTCOMES RESEARCH INSTITUTE (PCORI) FEE

WHEREAS the Affordable Care Act imposes a fee on HRA plan sponsors to help fund the Patient-Centered Outcomes Research Institute (PCORI), and

WHEREAS the PCORI Fee, required to be reported only once a year on the second quarter FORM 720 and paid by July 31, is based on the average number of lives covered under the plan for the twelve months of the previous plan year, and

WHEREAS, the Chairman of the Board of Supervisors has the authority to authorize said payments on an annual basis upon completion of Tax Form 720 by the County Treasurer, and

WHEREAS the applicable dollar amount is $3.00 per covered life on an annual basis, and WHEREAS, the Personnel Officer has determined the average number of covered lives for the Hamilton County 2022 plan year is 51, now, therefore, be it

RESOLVED, that the Hamilton County Board of Supervisors do hereby authorize payment of $153.00 made payable to Department of the Treasury, Internal Revenue Service, Ogden, UT 84201-0009, out of Account No. A9060.801, for the required 2022 PCORI Fee and the County Treasurer be so authorized, and the Personnel Officer be so advised.

PURCHASE FOR THE RENEWAL AND UPGRADE OF CURRENT NETMOTION SOFTWARE AND ASSOCIATED LICENSES – DHSES GRANT SI20-1028-E00

WHEREAS, Hamilton County has received a grant from New York State Department of Homeland Security and Emergency Services (DHSES) in the amount of $566,264.00, contract C197841, for a new communications system, and

WHEREAS, one phase of the communications project is a new Public Safety Answering Point (PSAP) located at the Hamilton County Sheriff’s dispatch, and

WHEREAS historically Hamilton County has used Brite for the purchase of laptops in patrol cars for the Hamilton County Sheriff’s Department. The software and maintenance for these laptops is called NetMotion, and

WHEREAS the PSAP currently function under NetMotion software and eleven associated licenses, and

WHEREAS the cost of the one-time purchase for the renewal and upgrade of the software and associated license, is $2,009.56, be it

RESOLVED, that the Hamilton County Board of Supervisors authorizes the purchase of NetMotion software and associated licenses for $2,009.56 with funds coming from Account No. A3645.0425 DHSES GRANT SI20-1028-E00.

SIGN CONTRACT FOR EVALUATION AND SERVICE PROVISION WITH CHILDREN’S THERAPY NETWORK FOR CHILDREN AGED 3-5 YEARS

WHEREAS Hamilton County is required to provide for Comprehensive evaluations for children aged 3-5, who reside within Hamilton County and have a suspected developmental delay through the Committee on Pre-School Special Education (CPSE) process, and

RESOLUTION TO CONTRACT FOR RABIES VACCINATION CLINICS – GLOVE CITIES VETERINARY HOSPITAL

WHEREAS, in NYS it is the responsibility of the local health department to have a system in place for the control and suppression of rabies, and

WHEREAS the Hamilton County Nursing Service (HCPHNS) holds periodic rabies vaccination clinics throughout the County which provides for free vaccination of taxpayers’ dogs, cats, and domestic ferrets, and

WHEREAS the services of a licensed veterinarian is required to provide this service, and WHEREAS, the Glove Cities Veterinary Hospital, 35 Harrison Street, Gloversville, NY has agreed to provide veterinarian services for HCPHNS, and

WHEREAS, the Glove Cities Veterinary Hospital has agreed to maintain membership in the American Veterinary Medical Association, making them eligible to maintain professional liability insurance at the required level, and

WHEREAS one licensed veterinarian from the Glove Cities Veterinary Hospital will be reimbursed at a rate of $100.00 per hour, to include travel time and clinic hours plus travel reimbursement at the prevailing county mileage rate, be it

RESOLVED, that the Chairman of the Board of Supervisors is authorized to enter into a contract with the Glove Cities Veterinary Hospital, to provide veterinary services at HCPHNS rabies clinics, at a rate of $100.00 per clinic hour, plus travel time and mileage reimbursement, as described above, to begin May 1, 2023 to April 30, 2024 upon approval of the County Attorney and the County Treasurer be so notified.

AUTHORIZING MOU WITH HEALTHY FAMILIES’ NORTH COUNTRY – SOCIAL SERVICES

WHEREAS New York State is expanding Healthy Families NY (HFNY) statewide to children and families across the state for families referred by the Department of Social Services, and

WHEREAS families referred to by the department will be able to be enrolled prenatally up until their child is 24 months and the HFNY staff will provide preventative supports and education, and

WHEREAS, Healthy Families North Country has been granted the contract to serve Hamilton County, and

WHEREAS, a Memorandum of Understanding (MOU) is required for the agency to accept referrals, be it

RESOLVED, that the Hamilton County Commissioner of Social Services is authorized to sign an MOU following the review and approval by the Chairman of the Board of Supervisors and review by the County Attorney.

AUTHORIZING PAYMENT TO WARRENSBURG COLLISION CENTER, INC. – INSURANCE REPAIR

WHEREAS Vehicle #918 - 2020 Chevy Malibu was involved in an accident and the repairs for the damage were completed by Warrensburg Collision Center, Inc., and

WHEREAS, the Fleet Coordinator recommends the payment of said repairs of the 2020 Chevy Malibu, be it

RESOLVED, the County Treasurer is hereby authorized to increase Account No. A1910.0402 Repairs to Vehicles-Insurance by $2,966.22 to be totally offset by increasing Revenue Account No. A2680.0000 Insurance Recoveries by $2,966.22, and be it further

RESOLVED, that the County Treasurer is hereby authorized to make a check payable to: Warrensburg Collision Center, Inc., Warrensburg, for Invoice #6060 in the amount of $3,166.20 and the funds be taken out of Account No. A1910.0402 Repairs to Vehicles-Insurance and the Fleet Coordinator and Clerk of the Board be so notified.

AUTHORIZING COUNTY FLEET COORDINATOR TO PURCHASE AUTOMOBILE FOR COMMUNITY SERVICES DEPARTMENT - 2023

WHEREAS the Community Services Department is in need of replacing a vehicle and the County Fleet Coordinator does recommend the replacement of the said vehicle, and

WHEREAS the Fleet Coordinator requested bids for a mid-size all-wheel drive sedan through the New York State Marketplace and received a bid for a 2023 Nissan Altima in the amount of 30,119.21, and

WHEREAS the Fleet Coordinator recommends the purchase of one (1) sedan for use in 2023 as follows per NYS Contract mini-bid #23166 Vehicles: (1) 2023 Nissan Altima AWD 4 door sedan - $30,119.21 be it

WHEREAS the vehicle that is to be replaced will be turned down to another department to be utilized and the Fleet Coordinator will determine where the most need is and place the used vehicle there, be it

RESOLVED, that $30,119.21 be transferred from the General Fund Unappropriated (Federal Salary Sharing) fund balance to Account No A4310.0201 Automobile Community Services, be it further.

APPROVAL OF EXPENDITURES FOR CONSTRUCTION OF COUNTY ROAD BRIDGE PROJECT – ROBBS CREEK BRIDGE

WHEREAS Robbs Creek Bridge located on Old Route 8b in the Town of Wells needs a new superstructure, decking and abutment work, and

WHEREAS, the DPW Superintendent has met with the Public Works Committee and recommends the rehabilitation of County owned Robbs Creek Bridge on Old Route 8b in the Town of Wells, and

WHEREAS the County Highway Superintendent recommends the appropriation of $150,000.00 for the rehabilitation of the following bridge project:

COUNTY BRIDGE PROJECT NO. 1 Town of Wells, Robbs Creek Bridge, BIN3307520, Old Route 8b - $150,000, Account No. D5120.2001 and

WHEREAS, the above designated bridge is owned by Hamilton County, be it

RESOLVED, that $150,000 be transferred from the Account No. D5112.0203 Bridge Projects to Account No. D5120.2001 for the rehabilitation of the above designated project as recommended by the County Highway Superintendent and the County Treasurer be so authorized to make the said transfer and Clerk of the Board and County Highway Superintendent be so advised.

NEW YORK STATE DIVISION OF HOMELAND SECURITY AND EMERGENCY SERVICES OVERPAYMENT REFUND CHECK

WHEREAS Hamilton County received reimbursement through New York State Division of Homeland Security and Emergency Services (DHSES) for FEMA repairs related to the 2019 Halloween Storm on County Route 8, and

WHEREAS FEMA reviewed the disbursement and determined that there was an overpayment of $23.62 due to a transposition error in the FEMA DVS summary, and

WHEREAS FEMA is requesting that the overpayment of $23.62 be returned to DHSES, be it

RESOLVED, that the County Treasurer be authorized to refund $23.62 to Division of Homeland Security and Emergency Services, Attn: Disaster Finance, 1220 Washington Avenue, Building 7A, 4th Floor, Albany, NY 12242 from Account No. D3960, State Aid, Emergency Disaster Assistance, and the Clerk of the Board and DPW Superintendent be so advised.

CONTRACT APPROVAL WITH CAPITAL DIGITRONICS FOR TOWER EQUIPMENT REPAIRS

WHEREAS Hamilton County Emergency Management was awarded SICG 18 Grant from NYS Statewide Interoperable Communications Targeted Grant in the amount of $6,000,000.00, contract C198029, and

WHEREAS, $50,000.00 of the SICG 18 Targeted Grant will be allocated for non- competitive procurement contract with Capital Digitronics for costs associated with communications tower equipment repairs, and

WHEREAS the term of this contract will be from 1/1/2023-12/31/2023, and WHEREAS, NYS DHSES has approved the contract and term of the contract, and WHEREAS, the Director of Emergency Management has on file an approval letter from NYS DHSES, be it

RESOLVED, that with the approval of the County Attorney, the Chairman of the Board of Supervisors is hereby authorized to enter into a contract with Capital Digitronics for a term of 1/1/23-12/31/23 for tower equipment repairs, for $50,000.00 to be utilized from SICG 18 Targeted Grant.

APPROVAL FOR TOWER ANTENNA REPLACEMENT – BLUE MT. – ST18-1005-D00

WHEREAS, Hamilton County has received a grant from New York State Department of Homeland Security and Emergency Services (DHSES) in the amount of $6,000,000.00 contract C198029, and

WHEREAS Capital Digitronics was the original installer of communications antennas on Blue Mountain, and

WHEREAS, through winter weather of snow and ice, two of the antennas suffered significant damage and parts were broken from the antennas, and

WHEREAS a Sole Source request was put in through NYS DHSES for replacement of these antennas to be covered with grant funds, and

WHEREAS NYS DHSES approved the sole source request in the amount of $2,260.00 for the antenna replacement, and

WHEREAS, Capital Digitronics will also be the installer, which is also reflected in the quote, be it

RESOLVED, that the Hamilton County Board of Supervisors authorizes the purchase of two antennas through Capital Digitronics in the amount of $2,260.00 with funds coming from A3645.0428 ST18-1005-D00.

AUTHORIZING REPLACEMENT OF AC CONDENSERS IN THE COUNTY SOCIAL SERVICES AND LEGAL WINGS – INDIAN LAKE COUNTY FACILITY

WHEREAS, after replacing the heating systems in the Social Service and Legal Wings in the Indian Lake building facilities in 2022 the air conditioning needs to be replaced in both wings, and

WHEREAS, it has been very difficult obtain written quotes, and

WHEREAS the Superintendent finally received two (2) written quotes to replace the AC condensers, and

WHEREAS the written quotes were from the following vendors –Thermal Associates - $52,830.00 total for both wings; Technical Building Services, Inc. - $38,250.00 for both wings.

WHEREAS, because it took so long to receive written quotes the Superintendent didn’t have time to go to public bid as both building wings are currently without air conditioning, and

WHEREAS, the DPW Superintendent moved forward with the ordering and scheduling the installation of condensers from Technical Building Services, Inc. (TBS) with verbal approval from the Public Works Committee, be it

RESOLVED, that hereby the Board of Supervisors authorizes the Superintendent for the purchase and installation of said AC condensers and it will be a charge to Account No. A1620.0414 Five-Year Building Project Plan and the County Treasurer, Clerk of the Board and DPW Superintendent be so notified.

AUTHORIZATION FOR CONSULTING FIRM FOR SCOPING FOR BUILDINGS PROJECTS - 2023

WHEREAS, the DPW Superintendent has met with the Public Works Committee on several occasions to discuss the 5-year Building Plan to perform maintenance and reconstruction of the county owned facilities, and

WHEREAS one of the projects needed to be done is a window replacement for the County Courthouse located in Lake Pleasant, and

WHEREAS, the Superintendent would like to begin scoping for a possible new public safety building, and

WHEREAS the Superintendent recommends hiring Foit-Albert Associates to perform these scoping tasks mentioned hereon, be it

RESOLVED, the Board of Supervisors hereby approves the Superintendent to hire Foit- Albert Associates to begin scoping the building projects mention hereon in the amount not to exceed $25,000.00 the County Treasurer, DPW Superintendent and Clerk of the Board be so advised.

HAMILTON COUNTY BOARD OF SUPERVISORS PROCLAMATION

On the Occasion of her Retirement Lori E. Abbott

WHEREAS we would like to express special recognition to Lori E. Abbott and to honor her for her twelve years of distinguished service with Hamilton County Real Property Tax Service; and

WHEREAS Lori began her career with Hamilton County Real Property Tax Service on February 22, 2011 as a Real Property Tax Service Aide; and

WHEREAS the Hamilton County Board of Supervisors wishes to express its sincere appreciation to Lori for her dedication to the outstanding performance of her duties during her tenure; and

WHEREAS it is the desire and honor of this Board to honor Lori E. Abbott

NOW, THEREFORE, BE IT RESOLVED, that we, the Hamilton County Board of Supervisors, do hereby commend and honor Lori E. Abbott for her many years of service and dedication as a Hamilton County employee and extend our heartfelt thanks for a job well done and offer our good wishes for an enjoyable retirement.
