County plans road projects

LAKE PLEASANT—The Hamilton County Board of Supervisors held their monthly meeting on May 5 and passed numerous resolutions including several to fix and improve county roads this summer. Included in the road projects approved are the following.
ENDITURES FOR COUNTY ROAD FUND PROJECTS FOR 2022
WHEREAS there has been appropriated in the 2022 highway budget the sum of
$1,206,246.65 for the construction of County Road Fund Projects for 2022 and these funds are 100% reimbursed through the Consolidation Highway Improvement Program (CHIP’s), and
WHEREAS, the County Highway Superintendent has recommended the expenditure of $950,000 for the construction of the following projects:
COUNTY ROAD PROJECT NO. 1 Town of Indian Lake - Co. Rd. No. 4 – Big Brook Rd., Improve drainage, recycle base and HMA Base @ 20 ft. Approx. 1.4 miles…$350,000. Account No. D5112.2531
COUNTY ROAD PROJECT NO. 2 Town of Hope - Co. Rd No. 15 – Old Northville Road, HMA overlay B&T @ 20 ft., Approx. 1.2 miles…$300,000, Account No. 5112.2532
COUNTY ROAD PROJECT NO. 3 Town of Indian Lake - Co. Rd No. 12 – Cedar River Road, Improve drainage, recycle base and HMA B&T @ 20 ft. Approx. 1.0 mile…$300,000, Account No. 5112.2533 and
WHEREAS the above designated roads and bridge are on a completed system of the Hamilton County road map adopted by the Board of Supervisors of Hamilton County and approved by the Commissioner of Transportation, be it
RESOLVED, that the Board of Supervisors of the County of Hamilton does allot and appropriate from Account No. D5112.0202 Capital projects, the sum of $950,000, for the construction of the above designated projects as recommended by the County Highway Superintendent and the County Treasurer and Clerk of the Board be so advised.
PAVEMENT MAINTENANCE ON VARIOUS COUNTY ROADS 2022
WHEREAS there has been appropriated in the 2022 highway budget the sum of
$250,000 for HMA for maintenance of County Roads, and
WHEREAS there are roads that need to have Hot Mix Asphalt overlay treatments to keep the road in overall good condition, and
WHEREAS the County Highway Superintendent recommends the approval of the following locations to have pavement maintenance completed,
County Route 7, Hope Falls Road, Town of Hope - Approx. 2.0 mile, Est - $120,000.
County Route 3 – North Point Road, Town of Long Lake - Approx. 2.3 miles, Est - $130,000.
Total estimate for all mileage - $250,000 and
WHEREAS purchase costs estimates are under New York State Contract or Piggyback Contracts from other County’s pricing which are subject to Escalation/De Escalation and above costs are based on estimates of current pricing, and
WHEREAS the above designated roads are on a completed system of the Hamilton County road map adopted by the Board of Supervisors of Hamilton County and approved by the Commissioner of Transportation, be it
RESOLVED, that the Board of Supervisors of the County of Hamilton does approve the said paving projects and funds be taken from Account No. D5110.0404 Asphalt and Emulsion in the estimated amount sum of $250,000 as recommended by the County Highway Superintendent and the Clerk of the Board be so advised.
IMPLEMENTATION AND FUNDING COSTS OF A TRANSPORTATION PROJECT, WHICH MAY BE ELIGIBLE FOR FEDERAL-AID AND/OR STATE-AID, OR REIMBURSEMENT FROM BRIDGE NY FUNDS
WHEREAS a Project for the Bridge NY 2021: County Road 4 Over Big Brook (BIN 3307240), Bridge Replacement, Town of Indian Lake, Hamilton County, P.I.N. 2754.69.121 (the Project") is eligible for funding under Title 23 U.S. Code, as amended, that calls for the apportionment of the costs such program to be borne at the ratio of 95% Federal funds and 5% non-federal funds; and
WHEREAS the Sponsor will design, let, and construct the “project,” and
WHEREAS the County of Hamilton desires to advance the Project by making a commitment of 100% of the costs of the work for The Project or portions thereof, with the understanding that qualified costs may be eligible for federal-aid, state-aid, or reimbursement from Bridge NY funds, be it
RESOLVED, that the Hamilton County Board of Supervisors hereby authorizes the County of Hamilton to pay in the first instance 100% of the federal and non-federal share of the cost of The Project work for the Project or portions thereof, be it further
RESOLVED, that the Hamilton County Board of Supervisors hereby agrees that the County of Hamilton shall be responsible for all cost of the project which exceed the amount of the NY Bridge Funding awarded to the County of Hamilton, be it further
RESOLVED, that the sum of $2,328,284.70. is hereby appropriated from Unappropriated County Road Fund Balance in accordance with Section 366 Subdivision 1 of the County Law and made available to cover the cost of participation in the above phase of the Project, be it further
RESOLVED, that in the event the full federal and non-federal share costs of the project exceeds the amount appropriated above, the Hamilton County Board of Supervisors shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the New York State Department of Transportation thereof, be it further
RESOLVED, that the Chairman of the Hamilton County Board of Supervisors hereby agrees that construction of the Project shall begin no later than twenty-four (24) months after award and that the project shall be completed within thirty (30) months of commencing construction, be it further
RESOLVED, that the Chairman of the Hamilton County Board of Supervisors be and is hereby authorized to execute all necessary Agreements, certifications or reimbursement requests for Federal Aid and/or State-Aid on behalf of the County of Hamilton with the New York State Department of Transportation in connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality's first instance funding of project costs and permanent funding of the local share of federal-aid and state-aid eligible Project costs and all Project costs within appropriations therefore that are not so eligible, be it further
RESOLVED, that a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project, be it further

WHEREAS Resolution No. 110-22 authorizes the DPW Superintendent to purchase a one (1) 2022 Freightliner Coronado road tractor for use by DPW, and WHEREAS, the said tractor ordered was delivered, and
WHEREAS, the Superintendent has inspected the said tractor and it meets specification and recommends payment of the tractor, be it
RESOLVED, the County Treasurer is hereby authorized to make payment to Tracey Road Equipment, Inc., 6803 Manlius Center Road, East Syracuse, NY 13057 in the amount of
$163,110.72 and the funds to be taken out of Account No. DM5130.0201 Road Equipment for the DPW and the County Highway Superintendent and the Clerk of the Board be so notified.
PURCHASE FOR WELDER/GENERATOR/COMPRESSOR COMBINATION
WHEREAS the DPW is need of a welder, generator, and air compressor for a service vehicle, and
WHEREAS, the Superintendent has found a combination welder/generator/compressor unit, and
WHEREAS the Superintendent feels this combination unit is the most practical as there is only one gasoline engine to maintain rather than two engines and less expensive than purchasing separate units, and
WHEREAS, W. W. Grainger has the said combination welder/generator/compressor under New York State Contract Award #22918, Vendor #1000009167 in the amount of $10,039.48, and
WHEREAS the Superintendent recommends the purchase of one (1) Speed-Aire Welder/Generator/Compressor for use in a DPW service vehicle, be it
RESOLVED, that the Fleet Coordinator is hereby authorized to order one (1) Speed-Aire Combination welder/generator/compressor for the DPW mentioned herein for a total of $10,039.48 delivered from W. W. Grainger and it will be a charge to Account No. DM5130.0201 Equipment and the DPW Superintendent, County Treasurer and the Clerk of the Board be so notified.
AUTHORIZING A COLLEGE STUDENT INTERNSHIP WITH THE HAMILTON COUNTY TREASURER’S OFFICE
WHEREAS, the Hamilton County Treasurer has been contacted concerning an internship at Hamilton County by Camryn Brenan, who is presently a student at Wells College studying political science and pre-law, and
WHEREAS the Treasurer feels there would be a mutual benefit to all parties to have an intern for this summer, and
WHEREAS, the Treasurer has funds in Account No. A1325.0108 Additional hours and would like to offer a stipend of $500 to be paid at the end of the internship through payroll, be it
RESOLVED, that Camryn Brenan of Wells be allowed to intern with Hamilton County for the 2022 summer as a temporary employee, and be it further
RESOLVED, that the Personnel Officer, County Treasurer and Clerk of the Board be so notified.
A RESOLUTION AUTHORIZING RENEWAL OF ANNUAL GIS APPLICATION HOSTING OF THE HOMS WEB APPLICATION (HAMCOMAPS.NET)
WHEREAS the Board of Supervisors initially authorized the original agreement with Fountains Spatial, Inc., for hosting and maintaining the server-based County GIS Mapping application known as HAMCOMAPS.NET, and
WHEREAS Fountains Spatial, Inc., has continued to host, maintain, and modify the HOMS application through coordination with the Hamilton County Real Property Tax Services Agency since the inception in 2010, and
WHEREAS, on 2016 Fountains Spatial, Inc., merged operations with VHB, an engineering firm with offices in Albany, NY, and VHB will continue to provide the same service level agreements and application hosting to Hamilton County on a year-to-year basis going forward, and the Real Property Tax Services Agency recommends the Hamilton County Board of Supervisors renew the annual hosting agreement with VHB for 2022, therefore, be it
RESOLVED, the Hamilton County Board of Supervisors hereby authorizes the renewal of a 1-year annual plan agreement (commencing January 1, 2022 through December 31, 2022) with VHB, of 100 Great Oaks Boulevard, Albany, NY, and payment of the annual fee of $6,000 (Six Thousand Dollars) in quarterly payments of $1,500 (Fifteen Hundred Dollars) for hosting the Hamilton County Online Mapping System (HOMS) a.k.a HAMCOMAPS.NET.
PROCLAMATION HONORING CATHLEEN E. ROGERS
WHEREAS Cathleen E. Rogers worked as a County Employee very faithfully since 1991 as the Democratic Election Commissioner in the Board of Elections Department, after serving in that capacity for thirty-one years,
NOW, THEREFORE, BE IT PROCLAIMED, that the Hamilton County Board of Supervisors, on behalf of the citizens of Hamilton County and fellow employees, commends and congratulates Cathleen E. Rogers on her retirement, and
BE IT FURTHER PROCLAIMED, that the Hamilton County Board of Supervisors expresses its appreciation to Cathleen E. Rogers for her years of dedicated service as a Hamilton County employee.
CHANGES TO HAMILTON COUNTY EMPLOYEE HANDBOOK
WHEREAS the Board of Supervisors closed the County facilities on February 4th, 2022 and April 19th, 2022 due to extraordinary weather conditions, and
WHEREAS, after reviewing the Hamilton County Handbook regarding emergency situations and closing procedures, the Board of Supervisors determined there was a need to edit and replace the policy, and
WHEREAS, after reviewing the emergency situations policy the Board of Supervisors has recommended editing the prior to reporting to work section, and
WHEREAS, the Board of Supervisors has recommended replacing the prior to reporting to work section in the employee handbook, be it
RESOLVED, that Section 503 Emergency Situations – Prior to Reporting to Work section be edited from: If a determination is made to close operations prior to the start of a workday, the Chairman of the Board of Supervisors will initiate notification to all affected employees. An employee who is directed not to report to work due to an emergency closing will not be paid for that workday. The employee may charge such absence to available vacation leave, compensatory time or personal leave credits or make up the time at a later date if agreed to by the Department Head, be it further
RESOLVED, that Section 503 Emergency Situations – Prior to Reporting to Work section be replaced with: If a determination is made to close operations prior to the start of a workday, the Chairman of the Board of Supervisors will initiate notification to all affected employees. A full-time or part-time employee who is directed not to report to work due to an emergency closing will be paid for the employee’s normal workday at the employee’s regular rate of pay for that day. Such time will not be included as time worked for the purpose of computing overtime.
If a full-time or part-time employee is directed to report to work during the emergency closing, they will be provided with “Emergency Closing Credit Hours (ECCH)” for the hours they worked that day, but in no circumstance more than their standard workday (7 hours, 8 hours, etc.). If an employee worked more than their standard workday, they will be compensated for those hours through their department’s payroll. When “ECCH” are used, such time will not be included as time worked for the purpose of computing overtime. The “ECCH” must be used by the end of the year in which it is earned or within 30 days, if earned in December. An employee who has previously scheduled a paid leave day must still charge the absence for the day to the appropriate paid leave, and be it further
RESOLVED, the policy is changed effective February 4, 2022, when the County first closed due to extraordinary weather conditions, and be it further
RESOLVED, that the Personnel Officer is hereby authorized to disseminate the changes to all employees and that a certified copy of this resolution be provided to the Hamilton County Personnel Officer.
ADDITION OF THE BUCK MT. FIRE TOWER TO THE HAMILTON COUNTY FIRE TOWER CHALLENGE
WHEREAS, in the Town of Long Lake, on lands owned by Cedar Heights Timber, LLC exists the Buck Mt. Fire Tower, and
WHEREAS, Hamilton County has a very successful Fire Tower Challenge, and WHEREAS, the Town of Long Lake wants to add this Fire Tower to the existing Fire Tower Challenge, and
WHEREAS Cedar Heights Timber, LLC is willing to enter into a 10-year agreement to open the Fire Tower to the public, and
WHEREAS, the Town of Long Lake has acted as lead agency for a State Environmental Quality Review Act (SEQRA) review of the recreation project and determined such project including parking lot, trail construction, and tower reuse constitute a Type II action, and
WHEREAS, the Town of Long Lake has proposed execution of an intermunicipal agreement with the County of Hamilton pursuant to Article 5-G of the General Municipal Law detailing the project responsibilities, now, therefore, be it
RESOLVED, that the Board of Supervisors of the County of Hamilton hereby confirms the actions of the Town of Long Lake acting as lead agency for said SEQRA review of said recreation project, and further confirms the Type II action finding and determination, and be it further
RESOLVED, that the Board of Supervisors of the County of Hamilton authorizes the Chairman, with the approval of the County Attorney, to enter into an intermunicipal agreement with the Town of Long Lake, pursuant to Article 5-G of the General Municipal Law, therein setting forth the responsibilities of the County and the Town with respect to said recreation project, and be it further
RESOLVED, that the Chairman of the Hamilton County Board of Supervisors is hereby authorized to enter into a 10-year access agreement with Cedar Heights Timber, LLC, with the approval of the County Attorney, and based on the following: Cedar Heights Timber, LLC/Finch Forest Management will have proposed South Sabattis Road Parking Area cleared and stumped (Tom Donnelly Logging of Long Lake to do the job).
Hamilton County will assist with trucking of gravel from CHT-Campus Pit to cover Parking Area (Tom Donnelly to grade).
Hamilton County will assist with trucking of Cobb rock from Mitchell’s Tahawus Mine to Parking Area for top cover (Tom Donnelly to grade).
Hamilton County will coordinate/contract with Adirondack Mountain Club and Hamilton County Soil & Water Conservation Crew to brush, sign, and construct 1.2 mile of hiking trail from Parking Area to Buck Mt. Fire Tower.
The Town of Long Lake will contract with Michael Vilegi to paint, replace steps, replace landings, replace Cab roof as well as install safety fencing on the stairs and landing areas on Buck Mt. Fire Tower.
Town of Long Lake will provide the seasonal porta-john, monitor Parking Area for litter/trash and do light trail maintenance. Any major trail repair necessary will be the responsibility of Hamilton County.
Town of Long Lake is to provide roadside signage at Parking Area for Buck Mt. Fire Tower Trail, No Camping signage, and Trail Head Kiosk.
Hamilton County will provide enforcement of the No Overnight Parking and No Camping provisions of the agreement.
Cedar Heights Timber, LLC will agree to a 10 year, no fee, recreational access lease with Hamilton County for the Parking Area, Hiking Trail, and Fire Tower. The Parking Area, Hiking Trail and Fire Tower will remain in the ownership of Cedar Heights Timber, LLC.
Hamilton County and the Town of Long Lake will indemnify, defend, and hold harmless Cedar Heights Timber, LLC free and harmless from any loss, injury, damage, claim, lien, cost, or expense, including without limitation attorney’s fees and costs that result in exercise of lease, breach of Agreement, or lack or compliance with laws of the State of New York.
Hamilton County and the Town of Long Lake shall maintain General Liability Insurance which policy shall have minimum limits of $1,000,000 combined single limit and $2,000,000 general aggregate and shall name Cedar Heights Timber, LLC as Certificate Holder, and Additional Insured. The County will also provide coverage under their Umbrella Liability at $5,000,000 per occurrence and $10,000,000 Aggregate, and be it also
RESOLVED that the Town of Long lake and Cedar Heights Timber, LLC be so notified. Seconded by
ASSESSMENT ROLL AND TAX BILL PRINTING SERVICES
WHEREAS, Section 502 of the Real Property Tax Law prescribes the form and content of the Assessment Rolls, Section 904 of the Real Property Tax Law prescribes the form and content of the Tax Warrants and Tax Rolls, and Section 922 of the Real Property Tax Law prescribes the form and content of the Tax Bills to be mailed to each taxpayer, and
WHEREAS Section 1532 of the Real Property Tax Law defines the powers and duties of the Director of Real Property Tax Services to include the authorization to supply municipalities with assessment rolls or other forms for use in connection with the preparation of assessment rolls or the collection of property taxes, and other related services pertaining to the assessment and taxation of real property as may be authorized by the legislative body of the county, and
WHEREAS, the Hamilton County Board of Supervisors has authorized the Director of RPTS by resolution to produce and provide the annual tax bills, tax collection rolls and assessment rolls for all of the taxing jurisdictions physically located inside the county, and
WHEREAS the Director of RPTS solicited proposals for production quotes from competing and capable vendors, performed due diligence and completed on-site visits, reviewed statements of work, and negotiated favorable print production and service costs commensurate with the County’s annual tax cycle needs, therefore,
BE IT RESOLVED, the Hamilton County Board of Supervisors hereby authorizes the Director of RPTS to enter into a 3-year agreement for contract print services with Cathedral Corporation of Rome, New York, for production of tax bills, tax collection rolls and assessment rolls on behalf of the taxing jurisdictions in Hamilton County through December 31st, 2024, per the specifications outlined in the AGREEMENT FOR PRINTED AND ELECTRONIC STATEMENT PRODUCTION dated the 28th day of April, 2022.
MORTGAGE TAX DISTRIBUTION
WHEREAS it appears from the reports of the County Clerk and the County Treasurer for the period October 1, 2021 through March 31, 2022, that there remains for distribution of moneys received by taxation on Mortgages pursuant to the provision of Article Eleven, Section 261 of the Tax Law, the sum of $173,595.50, for the distribution among the Towns and Village of the County of Hamilton, now, therefore, be it
RESOLVED, by the Board of Supervisors of the County of Hamilton that the sum of $173,595.50 be and the same hereby is apportioned as follows: Arietta - 13,618; Benson - $2,828.50; Hope - $6,014.50; Indian Lake - $47,207.50; Inlet - $40,110.50; Lake Pleasant - $11,838.21; Long Lake - $37,956.50; Morehouse - $1,284.50; Wells - $10,398 and be it further Village of Speculator - $2,339.29
RESOLVED, that the County Treasurer be authorized to pay the respective sums so appropriated to the Supervisors of said Towns.
ATTESTATION FOR NYS OMH AND NYS OASAS COLA
WHEREAS the New York State Office of Mental Health (NYS OMH) and New York State Office of Addiction Services and Supports (NYS OASAS) enacted budgets for 2022-23 included a 5.4% increase for salary and salary-related fringe benefits effective April 1, 2022, and
WHEREAS the statute authorizing that the increase requires that each provider sign Attestation forms for both NYS OMH and NYS OASAS that the funding be used to support salary and salary- related fringe benefit increases, be it
RESOLVED, that the Attestation forms be completed to indicate that Hamilton County Community Services will use the increase in funding to support salary and salary- related fringe benefit increases, and be it further
RESOLVED, that the Hamilton County Board of Supervisors hereby authorizes the Chairman to sign the Attestation form as requested by NYS OMH and NYS OASAS and the County Treasurer be so advised.
COMMUNITY SERVICES TO CONTRACT WITH LAKE PLEASANT CENTRAL SCHOOL FOR THE SCHOOL AND COMMUNITY PREVENTION INITIATIVE SERVICES
WHEREAS, Community Services has developed a Hamilton County School and Community Prevention Initiative that offers Hamilton County Schools a Clinical Social Worker and/or a Resource Officer services at a cost of $10,000 per year for one day of each service per week, and
WHEREAS Lake Pleasant Central School has agreed to contract for one (1) day per week of School Resource Officer (SRO) at a total cost of $10,000 for the year beginning July 1, 2022 through June 30, 2023, be it
RESOLVED, that upon approval of the County Attorney, Hamilton County Community Services is hereby authorized to contract with Lake Pleasant Central School for a School Resource Officer for an annual amount of $10,000 to be billed in monthly installments of $1,000 beginning September 1, 2022 and ending June 30, 2023.
COMMUNITY SERVICES TO CONTRACT WITH INDIAN LAKE CENTRAL SCHOOL FOR THE SCHOOL AND COMMUNITY PREVENTION INITIATIVE SERVICES
WHEREAS, Community Services has developed a Hamilton County School and Community Prevention Initiative that offers Hamilton County Schools a Clinical Social Worker and/ or a Resource Officer services at a cost of $10,000 per year for one day of each service per week, and
WHEREAS, Indian Lake Central School has agreed to contract for one (1) day per week of School Resource Officer (SRO) and two (2) days of Social Worker at a total cost of $30,000 for the year beginning July 1, 2022 through June 30, 2023, be it
RESOLVED, that upon approval of the County Attorney, Hamilton County Community Services is hereby authorized to contract with Indian Lake Central School for Social Work services and School Resource Officer Services for an annual amount of $30,000 to be billed in monthly installments of $3,000 beginning September 1, 2022 and ending June 30, 2023.

CONTRACT WITH CHILDREN’S HOME OF POUGHKEEPSIE
WHEREAS children placed in the care and custody of the Commissioner of Social Services as a result of abuse, neglect, maltreatment, or voluntary surrender require out-of-home placement in residential treatment centers, and
WHEREAS, these residential treatment centers are certified by the New York State Office of Children and Family Services (OCFS), and
