Sheriff’s Deputy Sean P. O’Brien Honored

LAKE PLEASANT—The Hamilton County Board of Supervisors honored Hamilton County Sheriff’s Deputy Sean P. O’Brien at its February 2 meeting with the following proclamation.

WHEREAS, On October 31st, 2022, Hamilton County Sheriff’s Deputy, Sean P. O’Brien was assisting the New York State Forest Rangers in Blue Mountain Lake for an overdue and possibly lost hunter when, at the command post located at the Blue Mountain trail head, he was notified of a structure fire just south of his location, and 

WHEREAS, Deputy O’Brien and two New York State Rangers immediately went to the scene and upon arriving found a fully engulfed residence and a passenger vehicle in the driveway, and

WHEREAS, Deputy O’Brien, not knowing if the residence was occupied, donned his fire coat and made his way to the front entry door. Upon feeling resistance, Deputy O’Brien forced open the door and could observe an unresponsive subject lying on the floor in the hallway. With the flames overtaking the residence and directly over the downed subject, Deputy O’Brien, without hesitation, entered the fully engulfed residence and grasped the subject and pulled him to the doorway where the two New York State Forest Rangers assisted in removing the subject to a safe location and to render first aid, and

WHEREAS, Once the unresponsive subject was removed to a safe location, Deputy O’Brien went back into the fully engulfed residence and yelled to see if there were any other occupants. After hearing nothing, Deputy O’Brien exited the residence and found a garden hose, to which, he began putting water onto the fire. Once fire apparatus arrived on scene, Deputy O’Brien retrieved a hose from the apparatus and continued fighting the fire until it was extinguished, and

WHEREAS, Deputy O’Brien, who is also the Hamilton County Fire Coordinator and Fire Investigator, remained on scene to investigate the origin of the fire, and

WHEREAS, Deputy O’Brien displayed extraordinary bravery and composure in entering the fully engulfed residence and by doing so, saved the life of an individual, and

WHEREAS, On January 17th, 2023, Deputy O’Brien was awarded the distinguished honor of Deputy of the Year by the New York State Sheriff’s Institute and Association

NOW, THEREFORE, BE IT RESOLVED, that we, the Hamilton County Board of Supervisors, do hereby commend and honor Deputy Sean P. O’Brien for his bravery and heroic actions that he took on that 31st day of October, 2022.

WHEREAS, the Hamilton County Public Health Nursing Service/Home Health Agency in furnishing its patient services receives reimbursement from the Federal and State Governments, private insurance and various other sources, and 

WHEREAS, UnitedHealthcare Insurance Company has done a routine review of claim payments finding that there was overpayment of $4,882.12 provided to Hamilton County Public Health Nursing Service/Home Health Agency, be it

FUNDING AIDS INSTITUTE ELC SCHOOLS GRANT – PUBLIC HEALTH

WHEREAS, Hamilton County Public Health has been awarded the AIDS Institute ELC Schools Grant Contract # 6896-01 in the amount of $218,343.00, and

WHEREAS, the funds have not entirely been spent, be it

RESOLVED, that the County Treasurer be authorized to fund the following Account: A4189.4105 Supplies & Misc. $38,073.58 to be totally offset by increasing Revenue Account No. A4401.3 by $38,073.58 and the Director of Public Health be so advised. 

FUNDING ELC COVID-19 ENHANCED DETECTION GRANT

WHEREAS, Hamilton County Public Health has been awarded the ELC COVID-19 Enhanced Detection Grant Contract # 6448-01 in the amount of $163,390.00, and

WHEREAS, the funds have not entirely been spent, be it

RESOLVED, that the County Treasurer be authorized to fund the following Account: A4189.4104 Supplies & Misc. $14,203.35 to be totally offset by increasing Revenue Account No. A4401.2 by $14,203.35 and the Director of Public Health be so advised. 

PERFORMANCE INCENTIVE AWARD – PUBLIC HEALTH

WHEREAS, Hamilton County Public Health has been awarded a Local Health Department Performance Incentive Award in the amount of $6,500.00, be it

RESOLVED, that the County Treasurer be authorized to fund Account No. A4050.413 at $3,000.00 and A4050.453 at $3,500.00 to be totally offset by funding Revenue Account No. A3401.3 at $6,500.00 and the Director of Public Health be so advised. 

HAMILTON COUNTY FIRE ADVISORY BOARD

WHEREAS, the Hamilton County Fire Coordinator, has requested the appointment of a County Fire Advisory Board, and 

WHEREAS County Law Section 225-a provides the authority for the County Board of Supervisors to make such appointments, and 

WHEREAS, the Fire Coordinator has worked through the Fire Chiefs from the various Fire Departments within Hamilton County to develop a list of representatives, as well as alternates in some instances, and 

WHEREAS, the Hamilton County Board of Supervisors also has the authority to appoint a representative from those towns which are not serviced by a department, now, therefore, be it

WHEREAS, the funds have not been spent entirely, be it

RESOLVED, that the County Treasurer be authorized to fund Account No. A3645.0402 Statewide Communications Grant SI18-1047-D00 at $27,050.71 to be totally offset by funding Revenue Account No. A3389.0302 – Statewide Communications Grant at $27,050.71 and the Director of Emergency Management and Sheriff be so notified.

FUNDING 2018 STATEWIDE INTEROPERABLE COMMUNICATIONS TARGETED GRANT – ST18-1005-D00

WHEREAS, the Hamilton County Emergency Management Department has been awarded the NYS 2018 Statewide Interoperable Communications Targeted Grant ST18-1005-D00 in the amount of $6,000,000.00, and

WHEREAS, the funds have not been spent, be it

RESOLVED, that the County Treasurer be authorized to create and fund Account No. A3645.0428 Statewide Communications Grant ST18-1005-D00 at $6,000,000.00 to be totally offset by creating and funding Revenue Account No. A3389.0132 Statewide Communications Grant at $6,000,000.00 and the Director of Emergency Management and Sheriff be so notified. 

PURCHASE OF LAND AND MOBILE RADIO EQUIPMENT FOR HAMILTON COUNTY SHERIFF’S OFFICE

WHEREAS, Hamilton County Emergency Management was awarded SICG Grant from NYS Statewide Interoperable Communications Formula Grant SI21-1050-E00 in the amount of $1.126,497.00, contract C197759, and

WHEREAS, $48,180.77 of Grant SI21-1050-E00 was allocated and will be used for land and mobile radio equipment, and

WHEREAS, the mobile and handheld radios and necessary equipment for installation for 

the Hamilton County Sheriff’s Office will be purchased from River Valley Radio Inc. under NYS Contract number PT 68713, and

WHEREAS, the upgraded mobile and handheld radio equipment will be programmed with mobile repeaters that will work with the upgrade to the CAD system, be it

RESOLVED, that the Director of Hamilton County Emergency Management Department is hereby authorized to purchase the mobile and handheld radios and necessary equipment for installation for the Hamilton County Sheriff’s Office from River Valley Radio Inc. for $48,180.77 from Account No. A3645.0427 – SI21-1050-E00 grant.

PURCHASE OF CONSOLES FOR THE PSAP CENTER FOR HAMILTON COUNTY SHERIFF’S OFFICE

WHEREAS Hamilton County Emergency Management was awarded SICG Grant from NYS Statewide Interoperable Communications Formula Grant SI21-1050-E00 in the amount of $1.126,497.00, contract C197759, and

WHEREAS, $23,970.47 of Grant SI21-1050-E00 will be allocated and will be used consoles in the PSAP upgrade that is taking place, and

WHEREAS, consoles will be purchased from Digital Video Group Inc. under GSA 

Contract Number GS03F0141W, and

WHEREAS, the consoles are part of the upgrade to the PSAP Center, be it

RESOLVED, that the Director of Hamilton County Emergency Management Department is hereby authorized to purchase the mobile and handheld radios and necessary equipment for installation for the Hamilton County Sheriff’s Office from River Valley Radio Inc. for $23,970.47 from Account No. A3645.0427 – SI21-1050-E00 grant.

APPROVAL OF PROFESSIONAL ENGINEERING SERVICES FOR 2023

WHEREAS, the Public Works Department needs professional engineering services during the year for different instances but not limited to road and bridge work, building permits and bridge flags, and

WHEREAS, A. S. Bell Engineering PC has given the Superintendent a proposal for professional engineering services for 2023, and

WHEREAS, A. S. Bell Engineering PC has many years of experience and years of 

experience for Hamilton County, and

WHEREAS, the Superintendent recommends moving forward with this proposal, be it

RESOLVED, that the Board of Supervisors does hereby authorize the Chairman of the Board to sign the proposal for professional engineering services from A. S. Bell Engineering PC for Hamilton County for 2023 and the County Treasurer, DPW Superintendent and Clerk of the Board be so advised.

AUTHORIZING PAYMENT TO JPJ FOR ANCILLARY EQUIPMENT FOR 2022 CHEVROLET TAHOE – SHERIFF’S OFFICE

WHEREAS Resolution No. 182-22 authorizes the purchase and installation of ancillary equipment from JPJ Electronics, Inc. installed at a cost of $18,756.34 for the 2022 Chevrolet Tahoe SSV, and

WHEREAS, the installation of the ancillary equipment has been completed and invoiced at a cost of $19,108.49, and

WHEREAS, the additional cost of $352.15 is due to actual shipping costs and the 

replacement of unavailable quoted items due to supply chain shortages, and

WHEREAS the work has been inspected by the Fleet Coordinator who recommends payment in the invoiced amount of $19,108.49, and

WHEREAS there is only a balance of $15,087.48 in Account A3110.0202 Automobile, and

WHEREAS, the Superintendent recommends a transfer of $4,021.01 be made from the General Fund Balance to Account No. A3110.0202 Automobile, be it

RESOLVED, that $4,021.01 be transferred from the Unappropriated General Fund Balance in accordance with Section 366 Subdivision 1 of the County Law to Account No. A3110.0202 Automobile and that hereby the County Treasurer is authorized to make the said transfer, be it further

RESOLVED, that payment is hereby authorized, and the County Treasurer be so authorized to send a payment of $19,108.49 to JPJ Electronics, Inc., 1 W. Whitesboro St., Yorkville, NY out of Account No. A3110.0202 Automobile and the Clerk of the Board, County Sheriff, and Fleet Coordinator be so notified.

AUTHORIZING MOA AND USE OF ARPA FUNDS FOR PAYMENT TO THE LAKE CHAMPLAIN LAKE GEORGE REGIONAL PLANNING BOARD (LCLGRPB) FOR THEIR WORK IN THE COMPLETION OF THE HAMILTON COUNTY ECONOMIC ANALYSIS OF HOUSING NEEDS

WHEREAS it is necessary to execute a Memorandum of Agreement between Hamilton County and the LCLGRPB for the Economic Analysis of Housing Needs project, and 

WHEREAS, the LCLGRPB has completed its work and preparation of an Economic Analysis of Housing Needs project in cooperation with Hamilton County, and 

WHEREAS, the Hamilton County has agreed to provide $10,000 in matching funds for execution of the work outlined in Contract Number NBRC21GNY07, and 

WHEREAS, Hamilton County representatives have also participated on the Working Group for the Analysis, now, therefore, be it

RESOLVED, that the Chairman of the Hamilton County Board of Supervisors is hereby authorized to sign the Memorandum of Agreement with the LCLGRPB for the Economic Analysis Housing Needs project, and be it further 

RESOLVED, that the County Treasurer be hereby authorized to create and fund Account No. A8020.0419 – ARP Act, Economic Analysis of Housing Needs in the amount of $10,000 to be totally offset by funding Revenue Account No. A4089.0200 – American Rescue Plan Act (ARPA) in the amount of $10,000, and be it further

RESOLVED, that the County Treasurer be authorized to pay the LCLGRPB Invoice 22-35 in the amount of $10,000 for their services from Account No. A8020.0419 – ARP Act, Economic Analysis of Housing Needs.

AUTHORIZING THE CHAIRMAN TO SIGN CONTRACTS WITH FACILITATORS, 

PRESENTERS AND GUIDES FOR THE 2023 BIRDING FESTIVAL

WHEREAS Hamilton County is sponsoring a county-wide Birding Festival in June of 2023, and

WHEREAS, this Festival consists of numerous separate events from June 8-11, 2023 including: outings, lectures, seminars and certain events will require paid guides, facilitators or presenters, and

WHEREAS, certain events require lengthier work days than in past years for paid 

facilitators, presenters, or guides, and

WHEREAS the pay scale has not increased since 2017, and

WHEREAS gas and food prices have increased, and the contractors are accommodating longer events as requested by the participants, and 

WHEREAS, the contractors are relied upon to make the event a success, therefore, be it

RESOLVED, that upon the approval of the County Attorney, the Chairman of the Board of Supervisors is hereby authorized to sign contracts with guides, facilitators and presenters, with the increased rates as follows: Each guide or facilitator will receive per outing, with a daily limit of two (2) guided outings per guide as follows: 4 hours or less $125.00, 5 hours or less $150.00, 6 hours or more $175.00, Lectures/Seminars $250.00, Total number of guided outings not to exceed eight (8) per each day of the festival, and be it further

RESOLVED, that the total amount spent for Outings, Lectures, and Related Events is not to exceed $5,000.00 and will be charged to Publicity Account No. A6410.404, Event Funding and the County Treasurer be so notified.

AUTHORIZATION TO PURCHASE MAINTENANCE AND LICENSES FOR IMPACT SOFTWARE

WHEREAS, Hamilton County Emergency Management was awarded SICG Grant from NYS Statewide Interoperable Communications Formula Grant SI20-1037-E00 in the amount of $566,267.00, contract T970900, and

WHEREAS, Hamilton County Public Safety Answering Point uses the IMPACT system for a Records Management System (RMS), Computer Aided Dispatch (CAD), and Automatic Vehicle Locater (AVL), and 

WHEREAS, Fulton County uses the same system for their Dispatch System which will afford the same information and protocols for a proper back-up system situation, and 

WHEREAS, IMPACT is under New York State Contact number PM67378, and WHEREAS, Hamilton County has received a bill for the annual maintenance and site licenses for the PSAP’s IMPACT system with the contract period running from January 1, 2023, thru December 31, 2023 in the amount of $17,657.34, be it

RESOLVED, that the Hamilton County Board of Supervisors authorizes the purchase of the maintenance and site licenses for IMPACT for $17,657.34, and be it further

RESOLVED, that the Hamilton County Treasurer is hereby authorized to issue a check to the IMAPCT (Central Square), 12079 Collection Center Drive, Chicago, IL 60693 for Invoice No. 366734 from Account No. A3645.0425, Department of Homeland Security and Emergency Services grant SI20-1028-E00.

CORRECTING COMMUNITY SERVICES RESOURCE OFFICER CONTRACTUAL ACCOUNT

WHEREAS, there is a shortage of funds in Account No. A4310.0430 Mental Health –Resource Officer Contractual, be it

RESOLVED, that the County Treasurer be hereby authorized to increase Account No. A4310.0430 Mental Health, Resource Officer Contractual by $25,261.66 to be totally offset by increasing Revenue Account No. A1289.0100 CS-RTA SCPI by $25,261.66.

AUTHORIZING THE HAMILTON COUNTY SOLID WASTE HAULING STATE GRANT CONTRACT

WHEREAS, Hamilton County has been awarded a 2-year Solid Waste Hauling Contract #DEC01-C01448GG-3350000 for $150,000.00 per year, be it

RESOLVED, that the Chairman is hereby authorized to sign NYS DEC Contract #DEC01-C01448GG-3350000 Hamilton County Solid Waste Hauling for a period of 4/1/21-3/31/23 and the County Treasurer and Highway Superintendent be so notified.

APPOINTMENT OF MEMBER TO THE HAMILTON COUNTY INDUSTRIAL 

DEVELOPMENT AGENCY

WHEREAS, pursuant to Section 856 of the General Municipal Law, the Hamilton County Industrial Development Agency shall consist of at least three (3) and not more than seven (7) members, all of whom shall be appointed by the Hamilton County Board of Supervisors, with all members serving at the pleasure of the Hamilton County Board of Supervisors, and

WHEREAS, the County of Hamilton and the Industrial Development Agency has received Joan Marsh’s resignation from the Industrial Development Agency, be it

RESOLVED, that Chris D. Rhodes of Arietta, NY is hereby appointed to fill the vacancy of Joan Marsh to serve as a member of the Hamilton County Industrial Development Agency, and be it further

RESOLVED, the Clerk of the Hamilton County Board of Supervisors is hereby directed to file a Certificate of Appointment to the Hamilton County Industrial Development Agency with the New York State Secretary of State.
